AN ORDINANCE approving and confirming
the assessments and assessment roll of Local
Improvement District No. 265, which has been
created and established for the purpose of
the improvement of S. R. 99 (Pacific Highway
South) from S. R. 516 (Kent Des -Moines Road)
to South 252nd Street by widening and over-
laying pavement with asphalt concrete, improv-
ing and extending shoulders where necessary,
and incidental work to provide for a fifth
lane to be used as a two-way left turn lane,
both within and outside the City, as provided
by Ordinance No. 1692, and levying and assess-
ing the amount thereof against the several lots,
tracts, parcels of land and other property
shown on the roll.
WHEREAS, the assessment roll levying the special assess-
ents against properties located in Local Improvement District No.
65 in the City of Kent, Washington, created under Ordinance No.
692, has been filed with the Clerk of the City of Kent, as pro-
ided by law; and
WHEREAS, notice of the time and place of hearing thereon
nd of making objections and protests to the roll was duly published
t and for the time and in the manner provided by law, fixing the
ime and place of hearing thereon for the 5th day of April, 1971,
t the hour of 7:00 o'clock p.m. in the Council Chambers of the
ity Hall in the City of Kent, Washington, and further notice
hereof was duly mailed by the City Clerk to each property owner
hown on that roll; and

23 hat notice the hearing was duly held and all written protests
24 eceived were duly considered and all persons appearing at the

25 rotests and requests for changes of assessments on the assessment

RDAIN AS FOLLOWS:
Section 1. The assessments and assessment roll of Local
mprovement District No. 265 , which has been created and establish

2 by widening and overlaying pavement with asphalt concrete, improv-
ing and extending shoulders where necessary, and incidental work
3 to provide for a fifth lane to be used as a two-way left turn lane,
4 both within and outside the City, as provided by Ordinance No. 1692
5 shall be and the same is hereby in all things and respects approved
and confirmed in the total amount of $72,080.73. Of this amount,
6
$61,055.67 shall be assessed upon property within the City and
7 $11,025.06 shall be assessed against property outside the City.
8 Section 2. Each of the lots, tracts, parcels of land
9 and other property shown upon the roll is hereby determined and
10 declared to be specially benefited by the improvements in at least
the amount charged against the same and the assessment appearing
11 against the same is in proportion to the several assessments
12 appearing upon the roll. There is hereby levied and assessed
13 against each lot, tract, parcel of land and other property appearin
upon the roll the amount finally charged against the same thereon.
14 Section 3. The assessment roll as approved and confirmed
15 shall be filed with the Treasurer of the City of Kent for collectio
16 and the City Treasurer is hereby authorized and directed to publish
notice as required by law stating that the roll is in her hands for
17 collection and payment of any assessment thereon or any portion of
18 that assessment can be made at any time within thirty days from
19 the date of the first publication of the notice without penalty,
interest or cost, and that thereafter the sum remaining unpaid may
20 be paid in ten equal annual installments with interest thereon
21 hereby fixed at the rate of 7 1/4% per annum. The first install-
22 ment of assessments on the assessment roll shall become due and
payable during the thirty-day period succeeding the date one year
23 after the date of first publication by the City Treasurer of notice
24 that the assessment roll is in her hands for collection and annuall
25 thereafter each succeeding installment shall become due and payable
in like manner. If the whole or any portion of the assessments
26 remains unpaid after the first thirty-day period, interest upon
27 the whole unpaid sum shall be charged at the rate of 7 1/4% per
28 annum and each year thereafter one of the installments, together
ith interest due on the whole unpaid balance, shall be collected.

thereupon become delinquent. All delinquent installments shall
be subject to a charge for interest at 7 1/4% per annum and for
an additional charge of 6% penalty levied upon both principal
and interest due upon such installment or installments. The
collection of such delinquent installments will be enforced in
the manner provided by law.
PASSED by the City Council and approved by the Mayor
Df the City of Kent, Washington, at a regular meeting thereof,
this 5th day of April, 1971, of which due notice was given in the
manner provided by law.
