AN ORDINANCE of the City of Kent, Wash-
ington, regarding the unlawful issuance of
bank checks or drafts; creating a presumption
of intent to defraud; and prescribing penalties
for violations of the ordinance.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
)RDAIN AS FOLLOWS:
Section 1. It is unlawful for any person with intent
to defraud, to make, draw, utter, or deliver to another person
any check, or draft, on a bank or other depository for the payment
Df money, knowing at the time of such drawing, or delivery, that
he has not sufficient funds in, or credit with said bank or depos-
itory, to meet said check in full upon its presentation. The word
°credit" as used herein shall be construed to mean an arrangement
or understanding with the bank for the payment.of such check or
draft, and the uttering or delivery of such check or draft to
another person, without such fund or credit to meet the same shall
be prima facie evidence of intent to defraud.
Section 2. Penalty for Violation. Any person found
guilty of violation of Section 1. of this Ordinance shall be deemed
guilty of a misdemeanor and shall be subject to fine not to exceed
$300.00 or imprisonment in the City Jail for not more than 90 days,
or by both such fine and imprisonment.
Section 3. This Ordinance shall take effect and be in
force five (5) days after its passage, approval and publication
as provided by law.
