ORDINANCE NO.
AN ORDINANCE of the City of Kent,
Washington, providing for the condemnation
and acquisition of certain land in the City
of Kent for the purpose of creating and
developing a public park and providing for
the payment of said land.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
RDAIN AS FOLLOWS:
Section 1. That the City Attorney for the City of Kent
9 be and he is hereby authorized and directed to purchase and/or
10 institute and prosecute to determination in the Superior Court of
11 the State of Washington, in the County of Kent, an action in the
name of the City of Kent for condemnation and acquisition of the
12 following described land, situated in the County of King, State of
13 Washington, for the purpose of the creation and development of a

lic park in the City of Kent, to -wit:
PARCEL I. (Pohl) Southeast quarter of the
Northeast quarter of Section 27, Township 22
North, Range 4 East, W. M., in King County,
Washington, EXCEPT the South half of the South half
of said subdivision, EXCEPT the east 220 feet of the
north half of said subdivision, EXCEPT portion there-
of, if any, lying easterly of a line 40 feet westerly
of the easterly shore of Lake Fenwick and EXCEPT
roads.
PARCEL 2. (Petty) The southeast quarter of the
northwest quarter of the northeast quarter of
Section 27, Township 22 North, Range 4 East, W.M.,
in King County, Washington, EXCEPT the south 30
feet of the west 168.73 feet thereof deeded out
for road under Auditor's File No. 5608867.
PARCEL 3. (Dehnert) That portion of the southwest
quarter of the northeast quarter in Section 27,
Township 22, Range 4 EWM and of lot 12, block 2,
Dehnerts addition (corrected) in Volume 71 of plats,
page 57, King County, defined as follows: Beginning
at the northeast corner of said subdivision thence
west along north line of said subdivision 360 feet
thence southeasterly to the southeast corner of said
lot 12, thence south and southwesterly along the
east and southeasterly line of said plat to the
north line of the south 25 acres of said subdivision
thence east to the east line of said subdivision
thence north along the east line of said subdivision
to point of beginning.

PARCEL 4. (Kemp) That portion of the northeast
quarter of the northeast quarter in Section 27,
Township 22, Range 4 E.W.M. defined as follows:
Beginning at the southwest corner of said sub-
division thence north along the west line of said
subdivision 404.12 feet thence east parallel with
north line of said subdivision 150 feet thence
southeasterly to a point on the south line of said
subdivision which lies 450 feet east of point of
beginning thence west along south line of said
subdivision to a point of beginning.
PARCEL 5. (Vasilatos) Beginning North 89° 46'
51" East 581.51 feet from the Southwest corner
of the Northeast 1/4 of the Northeast 1/4; thence
North 080 East 638 feet; thence East 110 feet;
thence South 731 14' East 57.24 feet; thence South
16° 8' East to the South line of subdivision; thence
West to beginning; less County Road, less Coal and
mineral rights; all in Section 27, Township 22,
Range 4 East W.M.
Section 2. That the acquiring of said land for the
.Durpose herein mentioned is for a public use and necessity.
Section 3. Payment for the land herein described to
De acquired shall be made from funds provided by the Interagency
�ommittee of the State of Washington (250), Department of Housing
and Urban Development (500), City of Kent (25%)(from Forward Thrust
Funds already allocated and set aside for this purpose).
Section 4. Nothing in this Ordinance shall be construed
is a waiver by the City of Kent of its right to decline to take
and pay for said land after the amount of damages has been ascer-
:ained and within the time allowed by law.
Section 5. This Ordinance shall take effect and be in
-Force five (5) days after its passage, approval and publication
as provided by law.
