HomeMy WebLinkAbout16591.45 1 ORDINANCE NO. 2 3 AN ORDINANCE of the City of Kent, Wash- ington, vacating a street within the city 4 limits of the City of Kent. 5 WHEREAS, the owners of more than two-thirds of the 6 roperty abutting a certain street located in the City of Kent, 7 incl County, State of Washington; and which is more fully d9scribed hereafter, have petitioned the Kent City Council to vacate $aid 8 street; and 9 WHEREAS, thereafter, the Kent City Council did, by 10 otion fix a time when said Petition would be heard and determined Dy the Kent City Council or a committee thereof, to -wit: Monday, 11 pril 20, 1970, at the hour of 7:00 o'clock P. M. in the Council 12 hambers of the City Hall of the City of Kent, Washington; and 13 WHEREAS, after the passage of said motion, the City Clerk Df the City of Kent gave twenty (20) days notice of the pendency 14 f said Petition by a written notice posted in three of the most 15 public places in the City of Kent and a like notice in a conspic- 16 aous place on the street sought to be vacated; said notice con- aining the information required therein by the Laws of the State 17 f Washington and the Ordinances of the City of Kent; and 18 WHEREAS, the Kent City Engineer has processed said Petitio 19 nd secured the technical facts pertinent to the question of said vacation which includes a sketch of the proposed vacation and also 20 ritten approval or rejection thereof by the water, sewer and 21 treet departments of the City of Kent; and 22 WHEREAS, thereafter said Petition, along with said technical information, was referred boa the Planning Commission of 23 �he City'of Kent for consideration at its next regular meeting; 24 aid Planning Commission recommending favorably on said Petition; 25 IpLna 26 WHEREAS, thereafter the hearing on said Petition was eld in the Council Chambers of the City Hall of the City of Kent 27 t 7:00 o'clock P. M. on the 20th day of April, 1970, and it 28 ppearing further that the granting of said Petition for the 29 acation of said street will not be a menace or inconvenience to he traveling public.or to any other persons using the streets 30 nd alleys of the City of Kent, Washington, -1- 1 2 3 4 ��... 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HENT, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The following described street within the City of Kent, Washington, and which is more fully described here- with: That portion of 27th Avenue South (formerly Mountain Avenue) lying West of lots 30 and 31, Block 20, Interurban Heights, Third Section and East of lots 12 and 13, Block 21, Interurban Heights, Third Section. is hereby vacated and will hereafter belong to the abutting property owners one-half (1/2) to each. Section 2. No vested rights shall be affected by the provisions of this Ordinance. Section 3. The City retains an easement or the Tight to exercise and grant easements in respect to the vacated street for the construction, repair and maintenance of public utilities and services. Section 4.
