_'; THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO HERE -
'[BY ORDAIN AS FOLLOWS:
Section 1. Section 5 of Ordinance 1972 which reads as fol-
lows:

"Section 5. Penalty. Any person violating any section of
this Ordinance shall be guilty of a misdemeanor and upon
conviction shall be punished by a find not to exceed
$250."
is hereby amended to read as follows:
"Section 5. Penalty. Any violation of this Ordinance
shall be an infraction and punishable by a monetary pen-
alty of not more than $25.00; PROVIDED, HOWEVER, that for
any person not requesting a mitigation hearing or con-
tested hearing for any violation under Sections 1, 2 or 3
of this Ordinance, the penalty shall be $5.00."
Section 2. Ordinance 2304 of the City of Kent is hereby
amended by adding a new section thereto which shall be designated
Section 3 and which shall read as follows:
v� "Section 3. Penalty. Any violation of this Ordinance
shall be an infraction and punishable by a monetary pen-
alty of not more than $25.00; PROVIDED, HOWEVER, that for
any person not requesting a mitigation hearing or con-
tested hearing, the penalty shall be $5.00."
Section 3 of Ordinance 2304 shall be re -numbered and shall be des-
ignated as Section 4 of the amended ordinance.
Section 3. Ordinance 2032 be and the same hereby is re-
pealed.
Section 4. This Ordinance shall take effect and be in force
five (5) days from and after its passage, approval and publication
as provided by law.
