AN ORDINANCE of the City of Kent, Washington, relating to library services; creating a new Chapter 2.36 in the Kent City Code; establishing a Library Board. WHEREAS, the City of Kent has long supported free and public libraries for its residents; and WHEREAS, a Library Board has long assisted the City in providing library services, but without official recognition; and WHEREAS, it is appropriate to recognize the work of past and present citizen participation on the Library Board by official) creation of a Library Board; NOW THEREFORE THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. A new Chapter 2.36 is added to the Kent City Code as follows: "2.36.010 Library Board Created. The Kent Library Board is hereby created. The Board shall consist of five (5) members. The members now appointed to and serving on the Library Board shall continue for the term for which appointed. As the term of each member expires, a successor shall be appointed by the Mayor with the approval of the majority of the City Council for a term of five (5) years. No member may serve more than two full terms. Members shall serve without compensation for their services but may receive necessary expenses actually incurred in connection with their services to the library. 2.36.020 Residence of Members and Vacancies. Only persons who are residents of the City or of a municipality which contracts with the City for library services shall be eligible for appointment to the Board. The position of a member shall become vacant upon such member's ceasing to reside within the City or ceasing to reside within a municipality which contracts with the City for library services. The position of a member shall be forfeited and become vacant for failure to attend three regular, consecutive meetings of the Board, unless such absence is excused by a majority of the members of the Board. 2.36.030 Meetings and Organization. The Board shall hold meetings at regular intervals as provided in bylaws adopted by the Board and shall meet not less frequently than every ninety (90) days. Members of the Board shall select a Chair- person from among themselves and such other officers as they may deem necessary and may establish rules for the conduct of their meetings and business of the Board. 2.36.040 Responsibilities of the Board. (A) The Board shall make reports and recommendations to the City Council, Mayor and City Administrator concern- ing the acquisition, care, mainten- ance, utilization and disposition of library buildings, property and equip- ment. The Board shall serve as an advisory body to the City Council, Mayor and City Administrator in all matters pertaining to library build- ings, equipment and other property, and the library budget. (B) The Board shall review, advise and make recommendations to the City Council, Mayor and City Administrator concerning the promulgation and enforcement of rules and regulations concerning the use of the library, its building and equipment and rules of conduct and behavior of persons using the same and frequenting the library building. The Board shall advise and make recommendations relative the the scope and quality of library services provided or to be provided and shall review and advise on all matters per- taining to the administration and performance of the City's contract with the King County Library Distrist for library services. 2.34.060 Gifts. The Library Board, in conjunction with the Library District, may accept or reject all gifts of money or property made for the benefit of the library and its patrons. All equipment and other property donated for library purposes whether through the Board or to the City directly, shall become the property of the City held in trust for library purposes and subject to the discretion of the legislative authority as - 2 - to any subsequent sale or disposition of any such property or investment of any such money." Section 2. Effective Date.
