AN ORDINANCE of the City of Kent,
Washington relating to fire prevention, and
Lb regulating fireworks; adopting a new Chapter
Q 13.09 Kent City Code to adopt by reference
Chapter 70.77 RCW, the State Fireworks Law;
enacting a City of Kent Fireworks Permit and
establishing a fee therefore; repealing Chapter
13.08 Kent City Code (Ordinance numbers 1242,
1247, 1796, 1873 and 1943).
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
ORDAIN AS FOLLOWS:
Section 1. A new Chapter 13.09 Kent City Code is adopted
as follows:
813.09.010. Chapter 70.77 RCW, the State Fireworks Law,
and Chapter 212.17 WAC enacted pursuant thereto by the State Fire
Marshall, be and the same are hereby adopted by reference.
"13.09.020. Pursuant to RCW 70.77.260 and 70.77.555, a
Kent Fireworks Permit shall be obtained from the Kent Fire
Department Bureau of Fire Prevention for all acts requiring a
license pursuant to Chapter 70.77 RCW. The fee for this permit
shall be Thirty-five Dollars ($35.00).
013.09.030. Any violation of the provisions of this
Chapter shall be an infraction and any person found in violation
thereof shall be subject to a penalty not to exceed Two Hundred
Fifty Dollars ($250)."
Section 3. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval, publication as provided by law, and upon the filing with
the City Clerk of one copy of Chapter 70.77 RCW and one copy of
Chapter 212.17 WAC.
