AN ORDINANCE of the City of Kent,
Washington, vacating a portion of South 202nd
Street, a certain street within the City Limits
of the City of Kent.
WHEREAS, proper application was filed with the City of
Kent for the vacation of a dedicated public street of the City; anc
WHEREAS, the Kent City Council did by resolution fix a
time when said petition would be heard, and said hearing was held,
on proper notice, on Monday, March 17, 1983, at the hour of
7:00 p.m. in the Council Chambers of the City Hall of the City of
Kent, Washington; and
WHEREAS, the Kent Planning Director processed said peti-
tion and secured technical facts pertinent to the question of said
vacation which includes a sketch of the proposed vacation and also
written approval or rejection thereof by the Public Works Depart-
ment of the City of Kent; and
WHEREAS, it appears the granting of said petition would
not be a menace or inconvenience to the traveling public or to any
other person using the streets or alleys of the City of Kent,
Washington; and
WHEREAS, the City Council directed the preparation of an
ordinance vacating said street; and
WHEREAS, the applicant has paid one-half of the appraised
value of said property; NOW, THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES
ORDAIN AS FOLLOWS:
Section 1. That portion of South 202nd Street within the
City Limits of Kent, Washington, and more fully described as
follows:
"That portion of South 202nd Street lying
west of Puget Power Right -of -Way, east of 72nd
Avenue South and lying between lots 15 and 16
O'Brien Station Garden Tracts No. 2 as recorded
in Volume 15 of plats page 66 King County,
Washington."
is hereby vacated, RESERVING, however, an easement for drainage,
and overhead or underground utilities in the westerly ten feet of
said portion of South 202nd Street. This vacation is further
conditioned on the following:
"Access to lots 15 and 16 of O'Brien Station
Garden Tracts No. 2 shall be limited to two
driveways for each lot on 272nd Avenue South,
with one additional shared driveway to be
permitted where South 202nd would have inter-
sected with 72nd Avenue South."
Section 2. No vested rights shall be affected by
the provisions of this ordinance.
Section 3. Effective Date. This ordinance shall
take effect and be in force five (5) days from and after
its passage, approval and publication as provided by law.
