AN ORDINANCE of the City of Kent, Washington approving and confirming the assess- ments and assessment roll of Local Improvement District No. 296, which has been created and established for the purpose of improving a portion of the City of Kent by the construction and installation of eight inch and ten inch sanitary sewers and ten inch and twelve inch water mains, and twelve inch, fifteen inch and twenty-five inch storm drainage in, along and near 72nd Avenue South from South 180th Street to South 184th Street and on South 182nd Street from 72nd Avenue South to the West Valley Highway; as provided by Ordinance 2197 and levying and assessing the amount thereof against this several lots, tracts, parcels of land and other properties shown on the roll. WHEREAS, the assessment roll levying the special assess- ment against the properties located in Local Improvement District No. 296 has been filed with the Clerk of the City of Kent as provided by law; and WHEREAS, notice of the time and place of hearing thereon and of making objections and protests to the roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereof for the 4th day of April 1983 at the hour of 7:00 p.m. in the Council Chambers of the City Hall in the City of Kent, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner shown on that roll; and WHEREAS, at the time and place fixed and designated in that notice, the hearing was duly held and written and verbal comments were received and considered by the City Council, and the hearing was continued until April 18, 1983, at which time further comments were received and considered by the Council; NOW THEREFORE THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES ORDAIN AS FOLLOWS: Section 1. The assessments and assessment roll of Local Improvement District No. 296 which has been created and estab- lished for the purpose of improving a portion of the City of Kent by the installation of eight inch and ten inch sanitary sewers and ten inch and twelve inch water mains, and twelve inch, fifteen inch and twenty-five inch storm drainage in, along and near 72nd Avenue South from South 180th Street to South 184th Street and on South 182nd Street from 72nd Avenue South to the West Valley Highway; as provided by Ordinance 2197, as the same now stands, be and the same is hereby in all things and respects approved and confirmed in the total amount of $420,799.72. Section 2. Each of the lots, tracts, parcels of land and/or properties shown upon the roll is hereby determined and declared to be specially benefitted by the improvements in at least the amount charged against the same and the assessment appearing against the same is in proportion to the several assess- ments appearing upon the roll. There is hereby levied and assessed against each lot, tract, parcel of land and other prop- erty appearing upon the roll the amount finally charged against the same thereon. Section 3. The assessment roll as approved and confirmed shall be filed with the Supervisor of Treasury Accounting of the City of Kent for collection, and the Supervisor of Treasury Accounting is hereby authorized and directed to publish notice as required by law stating that the roll is in her hands for collec- tion and a payment of any assessment thereof or any portion of that assessment can be made at any time within thirty (30) days from the date of the first publication of the notice without penalty, interest or cost, and that thereafter the sum remaining unpaid may be paid in ten (10) equal installments with interest thereon hereby fixed at the rate of 10-1/2% per annum, PROVIDED, however, that if the net effective interest rate fixed on the Local Improvement bonds hereafter issued for Local Improvement District No. 296 is other than 10-1/2% per annum, the interest rate on the unpaid assessment shall be revised to a rate of one half of one percent greater than the net effective interest rate on such bonds. The first installment of assessments on the assessment roll shall become due and payable during the thirty (30) day period succeeding the date one (1) year after the date of the first publication by the Supervisor of Treasury Accounting of notice that the assessment roll is in her hand for collection and - 2 - annually thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessment remains unpaid after the first thirty (3) day period, interest upon the whole unpaid sum shall be charged at the rate of 10-1/2% per annum and each thereafter one of the installments, together with interest due on the whole unpaid balance, shall be collected; PROVIDED, however, that if the net effective interest rate fixed on the Local Improvement bonds hereafter issued for Local Improvement District No. 296 is other than 10-1/2% per annum, the interest rate on the unpaid assessment shall be revised to a rate of one half of one percent greater than the net effec- tive interest rate on such bonds. Any installment not paid prior to the expiration of the thirty (30) period during which sum installment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a charge of interest of eight percent penalty levied upon both principal and interest due upon such installment or installments. The collec- tion of such delinquent installments will be enforced in the manner provided by law. Section 4. Effective Date.
