AN ORDINANCE of the City of Kent,
Washington, relating to public health and sani-
tation; amending Section 7.08.010 of the Kent
City Code to add Subsection H. to define "Dump
Fee", and Section 7.08.160 E. to clarify the
intent of the City Council that City overhead
charges are to be applied to the dump fee
portion of all garbage service charges.
WHEREAS, Ordinance No. 2365, entitled:
AN ORDINANCE of the City of Kent,
Washington, relating to public health and sani-
tation; repealing and reenacting Chapter 7.08 of
the Kent City Code providing for the maintenance
and operation of a system of garbage collection
and disposal; setting rates; providing for
inspection by the Kent Fire Department; provid-
ing penalties for violation of the City Code;
repealing Ordinance No. 2339.
established a comprehensive body of law regulating the maintenance
and operation of a system of garbage collection and disposal; and
WHEREAS, as reflected in the Finance Committee Minutes of
July 30, 1982, it was the City's intent that the markup for
overhead charges would be changed from 20% on residential
customers and 10% on commercial service to an across the board 12%
markup, including dump fees; and
WHEREAS, questions have arisin as to the applicability of
overhead charges on Dump Fees; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
HEREBY ORDAIN AS FOLLOWS:
Section 1. Section 7.08.010 of the Kent City Code, is
amended to add a new Subsection H. as follows:
H. "Dump Fee" means those actual charges
paid by the contractor for dumping garbage
at an approved site plus a City overhead
charge consistently applied to the Dump Fee
portion of all garbage services.

Section 3. This ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication as provided by law.
