AN ORDINANCE of the City of Kent,
Washington, relating to utilities; delaying
the effective date of the five dollar ($5.00)
fee imposed by Section 7.02.160 Kent City
Code (Ordinance 2371) for delinquent utility
accounts; crediting those accounts having
previously paid a delinquency fee.
WHEREAS, Ordinance 2371 entitled
"AN ORDINANCE of the City of Kent, Washington,
relating to utilities; amending Chapter 7.02 of the
Kent City Code; providing procedures for
applications for utilities service, establishing
procedures for billing for utilities service,
designating the City Treasurer as the person
responsible for accepting payment for utilities
service, and providing procedures for handling
delinquent utilities accounts; repealing Ordinances
1775, 1820, 1955, and 2300,"
passed by the City Council on November 1, 1982, signed by the
Mayor on November 2, 1982, and published pursuant to law on
November 5, 1982, amended Chapter 7.02 Kent City Code to add a
five dollar ($5.00) fee to a utility account if it becomes
necessary to mail out a past due reminder for a delinquent
account; and
WHEREAS, sufficient notice of the effective date of the
delinquency charge was not given to utility customers; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DO ORDAIN AS
FOLLOWS:
Section 1. The effective date of the five dollar ($5.00)
fee imposed by Section 7.02.162 Kent City Code is delayed until
the "Final Notice" billing for December utility accounts to be
mailed on January 24, 1983. Utility bills paid in the office of
the City Treasurer by January 23, 1983 shall not be assessed the
delinquency fee. Utility bills paid on or after January 24, 1983
shall be assessed the delinquency fee.
Section 2. The Municipal Utility Billing Department
shall give notice to all utility accounts of the five dollar
($5.00) fee imposed by Section 7.02.160 Kent City Code by direct
mailing to all current utility accounts.
Section 3. Those utility accounts billed, and having
paid a delinquency fee imposed by Section 7.02.160 Kent City Code
prior to January 23, 1983 shall have credited to such an account
the amount of the delinquency fee paid.
Section 4. This ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication as provided by law.
