ORDINANCE NO.O
AN ORDINANCE of the City of Kent,
Washington, relating to planning and property;
rezoning, with conditions, approximately 10
acres located on the south side of Southeast
248th Street at approximately 111th Avenue
Southeast, from R1-7.2, Single Family
Residential, and MR -M, Medium Density
Multi -Family Residential, to MR -G, Garden
Density Multi -Family Residential. (Howard
Rezone/RZ-82-02)
WHEREAS, a application for rezone was filed on April 27,
1982 for the following described property:
The East half of the East half of the
Northwest quarter of the Southeast quarter of
Section 20, Township 22 North, Range 5 East,
W.M., in King County, Washington; except the
North 30 feet thereof conveyed to King County`"
by deeds recorded under Auditor's File No. ,_,

street, utility and drainage purposes, by
instruments recorded under Auditor's File No.

and;
WHEREAS, the subject rezone concerns a request of Howard
Properties, Inc. to rezone from R1-7.2, Single Family Residential,
and MR -M, Medium Density Multi -Family Residential, to MR -G, Garden
Density Multi -Family Residential. Said property is located south
of Southeast 248th Street at approximately 111th Avenue Southeast,
extended (11013 Southeast 248th Street). The northern one half is
zoned R1-7.2 and the southern one half is zoned MR -M. The
approximate number of residential units which could be constructed
under existing zoning is 130 units. The proposed zoning with the
recommended limitation of 12 units per acre would allow a maximum
of approximately 115 units; and
WHEREAS, A Declaration of Nonsignificance was filed by
the Planning Department on June 16, 1982; and
WHEREAS, a public hearing was held before the Hearing
Examiner of the City of Kent on September 22, 1982; and
WHEREAS, the Hearing Examiner issued FINDINGS AND
RECOMMENDATION OF THE HEARING EXAMINER FOR THE CITY OF KENT on
October 6, 1982; and
WHEREAS, the City Council on November 1, 1982 approved by
motion the rezone with certain conditions recommended by the

Hearing Examiner. Those conditions being that the rezone be
approved subject to the following conditions:
1. The maximum number of units on the site shall be
limited to 12 units per gross acre.
2. The applicant shall enter into a no -protest L.I.D.
agreement with the City for improvements to
Southeast 248th Street and Southeast 252nd Street,
according to City Standards; and
WHEREAS, Howard Properties, Inc. by W. R. Brealey, Vice
President of Operations, has entered into an L.I.D. Covenant,
dated October 27, 1982. NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
HEREBY ORDAIN AS FOLLOWS:
Section 1. The following described land situated in the
City of Kent, County of King, State of Washington, and presently
zoned R1-7.2, Single Family Residential, and MR -M, Medium Density
Multi -Family Residential, and more particularly described as
follows:
East half of the East half of the Northwest
quarter of the Southeast quarter of Section
20, Township 22 North, Range 5 East, W.M., in
King County, Washington; except the North 30
feet thereof conveyed to King County by deeds
recorded under Auditor's File No. 263084 and
5073551; except the South 30 feet thereof
conveyed to the City of Kent for street,
utility and drainage purposes, by instruments
recorded under Auditor's File No. 7807130313
and 7807130314.
is hereby rezoned to MR -G, Garden Density Multi -Family Residential,
Section 2. The rezone is subject to and expressed upon
the condition that the maximum number of units on the site shall
be limited to 12 units per gross acre, and that a no -protest
L.I.D. agreement be entered with the City for improvements to
Southeast 248th Street and Southeast 252nd Street, according to
City Standards.
Section 3. The Planning Director of the City of Kent be
and he is hereby authorized and directed to indicate upon the
Comprehensive Zoning Map of the City of Kent or upon an addendum
thereto, the zoning of said property as provided for in Section 1
of this ordinance.

Section 4. That upon said amendment being shown upon the
Comprehensive Zoning Map of the City of Kent, or upon an addendum
thereto, the copy of said map or addendum shall be filed with the
Director of Records and Elections of King County Washington, and
the City Clerk of the City of Kent is hereby authorized and
directed to record this ordinance with the County Auditor of King
County and pay the filing fee therfore.
Section 5. This ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication as provided by law.
