AN ORDINANCE of the City of Kent, Washing-
ton, vacating a portion of 36th Avenue South, a
public street within the City of Kent.
WHEREAS, a proper application was filed for the vacation
lof a portion of 36th Avenue South within the City of Kent, and
WHEREAS, thereafter, the Kent City Council did, by
resolution, fix a time when said petition would be heard and
determined by the Kent City Council or a committee thereof,
to -wit: Monday, May 3, 1982 at the hour of 7 o'clock p.m. in the
Council Chambers of the City Hall, City of Kent, Washington, and
WHEREAS, after passage of said resolution the City Clerk
A the City of Kent gave twenty days notice of the pendency of
Said petition by a written notice posted in three of the most
3ublic places in the City of Kent and a like notice in a
:onspicuous place on the street sought to be vacated; and notice
containing the information required therein by the laws of the
State of Washington and the ordinances of the City of Kent; and
WHEREAS, the Kent Planning Director has processed said
Detitiou and secured the technical facts pertinent to the question
Df said vacation which includes a sketch of the proposed vacation
and also written approval or rejection thereof by the Water, Sewer
and Street Departments of the City of Kent; and
WHEREAS, the hearing on said petition was held in the
Council Chambers of the City Hall, City of Kent at 7 o'clock p.m.
on the 3rd day of May, 1982 and it appearing at said hearing that
the granting of said petition would not be a menace or
inconvenience to the travelling public or to any other persons
using streets and alleys in the City of Kent, Washington, NOW,
THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That a portion of 36th Avenue South located
within the city limits of Kent, more fully described in Exhibit A

attached hereto and incorporated herein by reference, be and the
same hereby is vacated.
Section 2. The above referenced vacation is expressly
conditioned on the following:
A. Reservation of storm drainage and utility easement
within said vacated alley.
Section 3. No vested rights shall be affected by the
provisions of this ordinance.
Section 4. This ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication as provided by law.
PASSED by the City Council and APPROVED by the Mayor of
the City of Kent, Washington at a regular open public meeting
thereof, thisday of I-, '�-_, 1982.

LEGAL DESCRIPTION
That portion of 36th Avenue South in the Northwest
quarter of Section 27, Township 22 North, Range 4 E, W.M., in King
County, Washington, being described as follows:
Beginning at the Northwest corner of Lot 1 of Block 4
of Kentwood Hills Division #1, as recorded in Volume 64 of Plats
on pages 62 and 63, the True Point of Beginning, thence South
00058'28" West, along the west line of said Lot 1, a distance of
138.13 feet, to the south line of said Lot 1; Thence South
88147118" East, along said south line, a distance of 26.91 feet;
Thence South 62040'58" West a distance of 47.59 feet; Thence North
