AN ORDINANCE of the City of Kent,
Washington, providing for the condemnation and
acquisition of certain property and property
rights in the City of Kent for the purpose of
widening and improving Smith Street at the
intersection with Lincoln Street, public
streets in the City of Kent within the
boundaries of Local Improvement District No.
304, and repealing Ordinance 2337.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
3EREBY ORDAIN AS FOLLOWS:
Section 1. That the City Attorney for the City of
Kent or his designee be and he is hereby authorized and
directed to purchase and or institute and prosecute to
determination in the Superior Court of the State of Washington,
County of King, an action in the name of the City of Kent for
condemnation and acquisition of the following described
property and property rights situated in the City of Kent,
County of King, State of Washington, for the purpose of
providing for the widening and improving of Smith Street at the
intersection with Lincoln Street, public streets in the City of
Kent within the boundries of Local Improvement District No. 304:
Parcel 1. (Hutchins - Bowl Investments - Drake)
That portion of Block 1 Guiberson's Addition as
recorded in Volume 14 of Plats, page 49 in King
County, Washington and the vacated alley included in
Block 1, described as follows:
Beginning at the Northwest corner of Lot 1 of said
Block 1, thence southerly along the westerly line of
said block to a point lying 2.03 feet southerly of the
northerly line of Lot 4 of said Block 1, said point
being on a curve, thence Northeasterly along the arc
of a curve with a radius of 130.00 feet an arc
distance of 202.22 feet to the Northerly line of said
Block 1, thence Westerly along said Northerly line to
the point of beginning (containing approximately
3499.64 square feet)
Section 2. That the acquiring of said property and
property rights for the purposes herein mentioned is for a
public use and necessity.
Section 3. Payment for property and property rights
herein described to be acquired shall be made from Local
Improvement District No. 304 funds.
Section 4. Nothing in this Ordinance shall be
construed as a waiver by the City of Kent of its rights to
decline to take and pay for said property or property rights

ime allowed by law.
Section 5. Ordinance 2337 of the City of Kent be and
he same is hereby repealed.
Section 6. This Ordinance shall take effect and be in
orce five (5) days from and after its passage, approval and
ublication as required by law.
