AN ORDINANCE of the City of Kent,
Washington, providing for the condemnation and
acquisition of certain property and property
rights in the City of Kent for the purpose of
providing easements and temporary construction
easements for water and storm drainage
improvements along and near 72nd South and
South 182nd Street within the boundaries of
Local Improvement District No. 296.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
(HEREBY ORDAIN AS FOLLOWS:
Section 1. That the City Attorney for the City of
Kent or his designee be and he is hereby authorized and
directed to purchase and or institute and prosecute to deter-
mination in the Superior Court of the State of Washington, in
the County of King, an action in the name of the City of Kent
for condemnation and acquisition of the following described
property and property rights situated in the City of Kent,
County of King, State of Washington, for the purpose of provid-
ing easements and temporary construction easements for water
and storm drainage improvements along and near 72nd Avenue
South and South 182nd Street within the boundaries of Local
!Improvement District 296.
Parcel 1. (Puget Sound Power and Light Co.) A
1permanent easement described as follows:
Beginning at the point of intersection with the
Easterly margin of 72nd Avenue South as conveyed to
the City of Kent by deed recorded under King County
Recording #7806301215 and the southerly line of Lot
18, Orillia Garden Tracts, according to the plat
thereof recorded in Volume 26 of Plats, page 7, in
King County, Washington, said point of being the True
Point of Beginning; thence North along the Easterly
margin of 72nd Avenue South a distance of 15 feet;
thence S 89050114" East to a point on the East line of
said lot; thence South along the Easterly line of said
lot a distance of 13.04 feet to the Southeast corner
of said lot; thence West along the South line of said
lot to the True Point of Beginning.
AND ALSO the North 10 feet of the South 28 feet of Lot
18, Orillia Garden Tracts, according to the plat
thereof recorded in Volume 26 of Plats, page 7, in
King County, Washington; lying Westerly of the
Westerly margin of 72nd Avenue South as conveyed to
the City of Kent by deed recorded under King County
Recording #7806301215.

together with a temporary construction easement described as
follows:
Beginning at the point of intersection with the
Easterly margin of 72nd Avenue South as conveyed to
the City of Kent by deed recorded under King County
Recording #7806301215 and the Southerly line of Lot
18, Orillia Garden Tracts, according to the plat
thereof recorded in Volume 26 of Plats Page 7, in King
County, Washington; thence North along the Easterly
margin of 72nd Avenue South a distance of 30 feet to
the True Point of Beginning; thence S 89050114" East
to a point on the East line of said lot; thence South
along the East line of said lot a distance of 151;
thence N 89050'14" West to a point which lies a dis-
tance of 15 feet North when measured from the point of
intersection with the Easterly margin of 72nd Avenue
South and the Southerly line of said lot; thence North
along the Easterly margin of 72nd Avenue South to the
True Point of Beginning. AND ALSO the North 10 feet
of the South 38 feet of Lot 18 AND ALSO the North 10
feet of the South 18 feet of Lot 18, Orillia Garden
Tracts, according to the Plat thereof recorded in
Volume 26 of Plats, Page 7, in King County, Washing-
ton; lying Westerly of the Westerly margin of 72nd
Avenue South as conveyed to the City of Kent by deed
recorded under King County Recording #7806301215.
Parcel A. (Puget Sound Power and Light Co. - Olympic
Pipeline Co.) A permanent easement described as follows:
That portion of Henry Adams Donation Claim in Section
36, Township 23 North, Range 4 East, W.M., in King
Countv. Washington, described as follows:
Beginning at the point of intersection with the cen-
terline of S. 182nd St. and the westerly margin of the
Puget Sound Power and Light Right -of -Way said point
being the TRUE POINT OF BEGINNING of the following
described property: thence northerly along said margin
a distance of 12.00 feet thence S 87039113" East a
distance of 100.00 feet more or less to a point on the
easterly margin of the Puget Sound Power and Light
Right-of-way thence southerly along said easterly
margin a distance of 34.00 feet thence N 60009113"
West a distance of 30.00 feet thence N 87039113" West
a distance of 73.00 feet more or less to a point on
said westerly margin; thence northerly along said
westerly margin a distance of 8.00 feet more or less
to the TRUE POINT OF BEGINNING.
Containing approximately 2190 square feet.
together with a temporary construction easement described as
follows:
That portion of Henry Adams Donation Claim in Section
36, Township 23 North, Range 4 East, W.M., in King
County, Washington, described as follows:
Beginning at the point of intersection with the
centerline of S. 182nd St. and the westerly margin of
the Puget Sound Power and Light Right of Way; thence

northerly along said westerly margin a distance of
12.00 feet to the TRUE POINT OF BEGINNING. Thence
S 87039'13" East a distance of 100.00 feet more or
less to a point of the easterly margin of said right
of way and also this point shall be for reference
purposes and referred to as "POINT A". Thence,
northerly along said easterly margin a distance of
15.00 feet thence N 87°39'13" West a distance of
100.00 feet more or less to a point on said westerly
margin thence southerly along said easterly margin a
distance of 15.00 feet more or less to the TRUE POINT
OF BEGINNING.
AND ALSO beginning at said "POINT A" thence southerly
along said easterly margin a distance of 34.00 feet to
the TRUE POINT OF BEGINNING of the following described
property. Thence N 60009'13" West a distance of 30.00
feet thence N 87039113" West a distance of 73.00 feet
more or less to a point on said westerly margin thence
southerly along said westerly margin a distance of
15.00 feet thence S 87039'13" East a distance of 69.00
feet thence S 60009113" East a distance of 35.00 feet
more or less to a point on said easterly margin thence
northerly along said easterly margin a distance of
17.00 feet more or less to said "POINT A" and the TRUE
POINT OF BEGINNING.
Containing approximately 3000 square feet.
Section 2. That the acquiring of said property and
property rights for the purposes herein mentioned is for a
public use and necessity.
Section 3. Payment for property and property rights
herein described to be acquired shall be made from Local
Improvement District No. 296 funds.
Section 4. Nothing in this ordinance shall be
construed as a waiver by the City of Kent of its rights to
decline to take and pay for said property or property rights
after the amount of damages has been ascertained and within the
time allowed by law.
Section 5. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
1publication as required by law.
