AN ORDINANCE of the City of Kent,
Washington, providing for the condemnation and
acquisition of certain property and property
rights in King County for the purpose of provid-
ing an easement and temporary construction ease-
ment for construction and installation of a water
line as a part of improvements provided for under
Local Improvement District No. 302 of the City of
Kent.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
HEREBY ORDAIN AS FOLLOWS:
Section 1. That the City Attorney for the City of Kent
be and is hereby authorized and directed to purchase and or insti-
tute and prosecute to determination in the Superior Court of the
State of Washington, County of King, an action in the name of the
City of Kent for condemnation and acquisition of the following
described property and property rights situated in King County,
State of Washington, for the purpose or providing an easement and
temporary construction easement for construction and installation
of a water line as a part of improvements provided for under Local
Improvement District No. 302 of the City of Kent:
Parcel 1. BURLINGTON -NORTHERN PERMANENT WATER LINE
That portion of the NE quarter of the SE
quarter of Section 25, Township 22 North,
Range 4 E.,W.M. described as follows:
Beginning at the SW corner of Tract 21 in
the plat of Horseshoe Acres Tracts as re-
corded in Volume 15 of Plats, page 10,
records of King County, Washington, thence
southerly along the east line of the North-
ern Pacific Railway right-of-way (also
known as Burlington Northern Railroad right-
of-way) a distance of 15 feet to the True
Point of Beginning. Thence continuing
southerly a distance of 12 feet, thence
west at right angles to the last described
line a distance of 100 feet to a point on
the west line of said railroad right-of-
way; thence north along the west line there-
of a distance of 12 feet, thence east a
distance of 100 feet to the True Point of
Beginning. TOGETHER with a temporary con-
struction easement over the following des-
cribed property:
A strip of land 15 feet in width running
parallel with and contiguous to the north
line of the above described property.
Section 2. That the acquiring of said land for the pur-

pose herein is for public use and necessity.
Section 3. Payment for land use herein described to be
acquired is to be made from city of Kent general revenue funds,
local improvement district funds, and from other city of Kent
general funds which may be allocated for the purpose.
Section 4. Nothing in this Ordinance shall be construed
as a waiver by the City of Kent of its rights to decline to take
and to pay for said land after the amount of damages has been
ascertained and within the time allowed by law.
Section 5. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and pub-
lication as provided '-'
