HomeMy WebLinkAbout2320ORDINANCE NO. ,�/ AN ORDINANCE of the City of Kent, �35 Washington, improving and confirming the assess- ments and assessment roll of Local Improvement District 299, which has been created and estab- lished for the purpose of improving a portion of the City by the installation of 8 inch sanitary sewers together with necessary appurtenances on easements on Helen Street and on Sam Street from West Valley Highway to a point 520 feet east of West Valley Highway as provided by Ordinance 2213 and levying and assessing the amounts thereof a- gainst the several lots, tracts, parcels of land and other properties shown on the roll. WHEREAS, the assessment roll levying the special assess- ments against the properties located in Local Improvement District; No. 299, has been filed with the Clerk of the City of Kent, as provided by law; and WHEREAS, notice of the time and place of hearing thereon and of making objections and protests to the roll was duly pub- lished at and for the time and in the manner provided by law, fix- ing the time and place of hearing thereof for the 19th day of October, 1981, at the hour of 8 o'clock p.m. in the Council Cham- bers of the City Hall in the City of Kent, Washington, and further' notice thereof was duly mailed by the City Clerk to each property owner shown on that roll; and WHEREAS, at the time and place fixed and designated in that notice, the hearing was duly held and written and verbal pro-, tests were received and considered by the City Council. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The assessments and assessment roll of Local Improvement District No. 299 which has been created and establish- ed for the purpose of improving a portion of the city by the in- stallation of 8 inch sanitary sewers together with necessary ap- purtenances on easements and on Helen Street and on Sam Street from West Valley Highway to a point 520 feet east of West Valley Highway as provided by ordinance 2213, as the same now stands, be and the same are hereby in all things and respects approved and jconfirmed in the total amount of $85,935.72. Section 2. Each of the lots, tracts, parcels of land and other property shown upon the roll is hereby determined and de- clared to be specially benefited by the improvements in at least the amount charged against the same and the assessment appearing against the same is in proportion to the several assessments ap- pearing upon the roll. There is hereby levied and assessed agains each lot, tract, parcel of land and other property appearing upon the roll the amount finally charged against the same thereon. Section 3. The assessment roll as approved and confirmed shall be filed with the Supervisor of Treasury Accounting of the City of Kent for collection, and the Supervisor of Treasury Ac- counting is hereby authorized and directed to publish notice as I required by law stating that the roll is in her hands for collec- tion and payment of any assessment thereof or any portion of that assessment can be made at any time within thirty (3) days from the date of the first publication of the notice without penalty, inter est or cost, and that thereafter the sum remaining unpaid may be paid in ten (10) equal installments with interest thereon hereby fixed at the rate of 10 1/2% per annum, provided, however, that if the net effective interest rate fixed on the local improvement bonds hereafter issued for Local Improvement District No. 299 is other than 10% per annum, the interest rate on the unpaid assess- ment shall be revised to a rate of 1/2 of 1% greater than the net effective interest rate on such bonds. The first installment of assessments on the assessment roll shall become due and payable during the thirty (30) day period succeeding the date one (1) year after the date of the first publication by the Supervisor of Treasury Accounting of notice that the assessment roll is in her hand for collection and annually thereafter each succeeding in- stallment shall become due and payable in like manner. If the whole or any portion of the assessment remains unpaid after the first thirty (30) day period; interest upon the whole unpaid sum shall be charged at the rate of 10 1/2% per annum and each year 1 thereafter one of the installments, together with interest due on i the whole unpaid balance, shall be collected; provided, however, that if the net effective interest rate fixed on the local improve ment bonds hereafter issued for Local Improvement District No. 299 is other than 10% per annum, the interest rate on the unpaid as- sessment shall be revised to a rate of 1/2 of 1% greater than the net effective interest rate on such bonds. Any installment not paid prior to the expiration of the thirty (30) day period during - 2 - which sum installment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a change of interest of 8% penalty levied upon both principal and interest due upon such installment or installments. The collec- tion of such delinquent installments will be enforced in the manne provided by law. Section_ 4.
