HomeMy WebLinkAbout2278ORDINANCE NO. c j� AN ORDINANCE of the City of Kent, Washington, providing for the condemnation and acquisition of certain property and prop- erty rights in the City of Kent for the pur- pose of provding easements and temporary construction easements for sanitary sewers along and near 94th Place South and South 218th Street within the boundaries of Local Improvement District No. 287. THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. That the City Attorney for the City of Kent be and he is hereby authorized and directed to purchase and or institute and prosecute to determination in the Superior Court of the State of Washington, in the County of King, an action in the name of City of Kent for condemnation and acquisition of the following described property and property rights situated in the City of Kent, County of King, State of Washington, for the purpose of providing easements and temporary construction easements for sanitary sewers along and near 94th Place South and South 218th Street within the boundaries of Local Improvement District 287. Parcel 4. (Stanchfield) A permanent easement described as follows: A 15.00 foot strip the centerline of which is described as follows: Beginning at the Southeast corner of the East half of the Northwest quarter of the North- west quarter of the Southeast quarter of Sec- tion 7, Township 22 North, Range 5 East, W.M.; thence North along the easterly line of said section a distance of 30.0 feet; thence west- erly parallel with the South line of said sub- division a distance of 109.84 feet to the True Point of Beginning of centerline herein des- cribed; thence North 1048117" West a distance of 269.26 feet; thence North 34003100" West a distance of 337.00 feet thence North 1141' 04" West a distance of 77.58 feet to the North line of said subdivision and the terminus of said centerline. together with a temporary construction easement described as fol- lows: That portion of the East half of the Northwest quarter of the Northwest quarter of the South- east quarter of Section 7, Township 22 North Range 5 East, W.M. described as follows: Beginning at a point where the North line of South 218th Street intersects the East line of said subdivision; thence West along the North line of 218th Street, a distance of 89.84 feet; thence North 1048117" west a distance of 275.65 feet; thence North 341031 00" West a distance of 336.98 feet; thence North 1041104" West a distance of 71.20 feet to a point on the North line of said subdivision thence West along said North line a distance of 12.50 feet; thence South 1041104" East a dis- tance of 75.18 feet; thence South 34103100" East a distance of 336.99 feet; thence South 1148117" East a distance of 271.66 feet to the northerly line of 218th Street; thence East along said northerly line a distance of 12.50 feet to the True Point of Beginning AND ALSO, Beginning at a point where the North line of South 218th Street intersects with the East line of said subdivision; thence West along the North line of said street a distance of 129.84 feet; this being the True Point of Beg- inning; thence North 1148117" West a distance of 262.86 feet; thence North 34103100" West a distance of 322.30 feet to the westerly line of said subdivision; thence northerly along said westerly line a distance of 96.14 feet to the Northwest corner of said subdivision; thence South 1141104" East a distance of 79.98 feet; thence South 34103100" East a distance of 337.01 feet; thence North 1148117" East a distance of 266.86 feet to the South line of said subdivision; thence East along south line of said subdivision a distance of 12.50 feet to the True Point of Beginning. Parcel 5. (Burks) A temporary easement describ- ed as follows: That portion of the West half of the Northwest quarter of the Northwest quarter of the South- east quarter of Section 7, Township 22 North,, Range 5 East W.M., in King County, Washington described as follows: Beginning at the Northeast corner of said sub- division being the True Point of Beginning; thence West along the North line thereof a dis- tance of 83.96 feet; thence southeasterly to a point on the East line of said subdivision which point lies 96.14 feet from the True Point of Beginning; thence northerly along said East line a distance of 96.14 feet to the True Point of Beginning. Parcel 16. (James) A permanent easement described as follows: That portion of the South half of the Northwest quarter of the Southwest quarter of the North- east quarter of Section 7, Township 22 North, Range 5 East, W.M. in King County, Washington; EXCEPT the West 30.00 feet thereof, EXCEPT the East 30.00 feet thereof, and EXCEPT the East 170.00 feet of the South 230.00 feet of the - 2 - remainder described as follows: Beginning at the most Northerly and Easterly corner of the above described subdivision, said point being the True Point of Beginning of the property, herein described; thence North 89057151" West along the Northerly line thereof a distance of 187.26 feet; thence South 6120111" West a distance of 330.53 feet more or less to a point on the most Southerly line of said subdivision; thence Easterly a- long the Southerly line of said subdivision a distance of 15.00 feet; thence North 6020' 11" East a distance of 300.00 feet more or less to a point which lies 30.00 feet south of the Northerly line of said subdivision; thence Easterly along a line parallel with the North- erly line of said subdivision a distance of 174.76 feet more or less to a point on the most Easterly line of said subdivision; thence Northerly along said Easterly line a distance of 30.00 feet to the True Point of Beginning. together with a temporary construction easement described as fol- lows: That portion of the South half of the North- west quarter of the Southwest quarter of the Northeast quarter of Section 7, Township 22 North, Range 5 East, W.M.; in King County,. Washington; EXCEPT the West 30.00 feet thereof, described as follows: Beginning at the most Northerly and Easterly corner of the above described subdivision; thence North 89057151" West along the North- erly line thereof a distance of 229.76 feet to the True Point of Beginning of the prop- erty herein described; thence South 6°20111" West a distance of 318.03 feet more or less to a point which lies 12.5 feet Northerly of the Southerly line of said subdivision; thence North 89058158" West parallel to said Southerly line a distance of 50.00 feet; thence South 6020' 11" East a distance of 12.5 feet to a point on the Southerly line of said subdivision; thence South 89058158" East a distance of 62.5 feet; thence North 6°20111" East a distance of 330.53 feet more or less to a point on the most Northerly line of said sub- division; thence Westerly along said North- erly line a distance of 12.5 feet to the True Point of Beginning; .AND ALSO, Beginning at point 30.00 feet Southerly of the most North- erly and Easterly corner of the aforesaid described subdivision; thence North 89°57151" West a distance of 202.26 feet to the True Point of Beginning; thence South 6°20111" West a distance of 300.00 feet more or less to a point on the Southerly line of said sub- division; thence South 89058158" East along said Southerly line a distance of 132.50 feet; thence North 6020111" East a distance of 12.5 - 3 - feet; thence North 890581581" West a dis- tance of 120.00 feet; thence North 6020111" East a distance of 288.5 feet more or less to a point which lies 30.00 feet South of the North line of said subdivision; thence North 89057151" West a distance of 12.5 feet to the True Point of Beginning. Section 2. That the acquire of said property and property rights for the purposes herein mentioned is for a public use and necessity. Section 3. Payment for property and property rights herein described to be acquired shall be made from Local Improve- ment District No. 287 funds and from other City of Kent general funds which may be allocated for the purpose. Section 4. Nothing in this ordinance shall be con- strued as a waiver by the City of Kent of its rights to decline to take and pay for said property or property rights after the amount of damages has been ascertained and within the time allow- ed by law.
