HomeMy WebLinkAbout2275ORDINANCE NO. c_ �' ?� AN ORDINANCE of the City of Kent, Washington, creating an account to be known as the Kent Senior Center Building Account, establishing the purpose for the account, providing for payments into and appropriations from the account, proce- dures to be followed upon dissolution of the account. THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO HEREBY ORDAIN: Section 1. There is hereby created a special accoun entitled the "Kent Senior Center Building Account" to be included within the trust funds of the City of Kent. Section 2. The purpose of the account is to create a fund for the future expansion or relocation of the Kent Senior Center. Section 3. Deposits into the account may be by way of donations, gifts, bequests, or devises, or from funds of the City appropriated to the account at the direction of the City Council. Section 4. Appropriations from the account shall be made solely at the discretion of and at the direction of the City Council, and solely for the purpose of expansion or relocation of the Kent Senior Center, subject to the provisions of Section 5 relating to dissolution of the account. Section 5. Should it be determined that the account will not generate sufficient funds, or if it shall be determined that the Kent Senior Center not be expanded or relocated, then in that event the account shall be dissolved. Funds remaining in the account at the time of dissolution shall be distributed in accordance with the direction of those persons who have made donations, gifts, bequests, or devises to the account, or in the event no such direction has been given, the fund shall be used fo such purposes related to the operation, maintenance or program enhancement of the Senior Center as the City Council may deter- mine. Section 6. The Director of Parks and Recreation or his designee is hereby authorized and directed to devise a form for the receipt of donations, gifts, devises and bequests, which form shall contain, as a minimum, a statement that the funds are for the purpose of expansion or relocation of the Kent Senior Center, and a further statement that unless expressly stated to the contrary any funds on deposit at the time of dissolution of the account may be used at the discretion and direction of the City Council for operation, maintenance or program enhancement at the Kent Senior Center.
