HomeMy WebLinkAbout2258ORDINANCE NO. 52 AN ORDINANCE of the City of Kent, Washington, defining terms, creating a Traffic Violations Bureau, establishing its duties, and repealing Ordinance 1952. THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. DEFINITIONS. For the purposes of this Ordinance the following definitions shall apply: a) Traffic Infraction. The term "traffic infraction" shall mean any offense designated as a traffic infraction under t RCW 46.63.020 and any additions or amendments thereto. b) Monetary Penalties. The term "monetary penalties"I shall mean those sums determined by rules promulgated by the courts of this state to be appropriate penalties to be assessed for traffic infractions. Section 2. TRAFFIC VIOLATIONS BUREAU CREATED. The Kent Traffic Violations Bureau is hereby established. The bureau I shall operate under the auspicious of the Kent Finance Department and in conjunction with the Aukeen District Court. The bureau shall be staffed by such persons and shall be open at such hours as are designated by the Finance Director. ! j Section 3. POSTING OF BAIL OR MONETARY PENALTIES WITH TRAFFIC VIOLATIONS BUREAU - FORFEITURES. The Traffic Violations Bureau may accept bail or monetary penalties for those offenses or traffic infractions which by effect of statute, ordinance or court rule may be disposed of other than by mandatory court ap- pearance. Provided, that this section shall not preclude a per- li son charged with an offense or infraction from requesting a trial or hearing as authorized by law. Section 4. DUTIES OF TRAFFIC VIOLATIONS BUREAU. Duties of the Traffic Violations Bureau shall include among others the following: a) It shall accept designated bail or monetary pen- alties from and issue receipts to such violators as are permitted to and who desire to forfeit bail or who desire to accept the 'i determination that a traffic infraction has been committed. b) It shall keep a proper and complete record of all bail forfeitures or forfeitures of monetary penalties in cases wherein any person has been charged with violation of the traffic ordinances of the City of Kent, together with a record of the final disposition of all such alleged offenses and infractions. c) It shall keep a record of all serially numbered citation forms issued by the Police Department to individual police officers, the record to include any forms spoiled or upon which an entry has been made but the form not issued to an al- leged violator. d) It shall forward to the Aukeen District Court the i names of those persons who fail to respond to a traffic citation or notice of traffic infraction as the same may be required by any statute, ordinance or court rule. Section 5. REPEAL. Ordinance No. 1952 of the City of Kent and any ordinances or parts of ordinances in conflict here- with are hereby repealed. Section 6. EFFECTIVE DATE. This Ordinance shall take effect and be in force on and after January 1, 1981.
