AN ORDINANCE of the City of Ke4N 16 '0

Washington, vacating a portion of Helen
Street, a public street in the City of Kept.

WHEREAS a proper application was filed for the vacation
of a portion of a public street in the City of Kent, and
WHEREAS thereafter, the Kent City Council did, by
resolution fix a time when said petition would be heard and deter-
mined by the Kent City Council or a committee thereof, to -wit:
Monday, June 2, 1980 at the hour of 8 o'clock p.m. in the Council
Chambers of the City Hall of the City of Kent, Washington; and
WHEREAS after the passage of said resolution, the City
Clerk of the Citv of Kent gave twenty (20) days notice of the
pendency of said petition by a written notice posted in three (3)
of the most public places in the City of Kent and a like notice
in conspicuous places on the street sought to be vacated; said
notice containing the information required therein by the Laws of
the State of Washington and the ordinances of the City of Kent;
and
WHEREAS the Kent Planning Director has processed said
petition and secured the technical facts pertinent to the ques-
tion of said vacation which includes a sketch of the proposed
vacation and also written approval or rejection thereof by the
water, sewer and street departments of the City of Kent; and
WHEREAS the hearing on said petition was held in the
Council Chambers of the City Hall of the City of Kent at 8:00
o'clock p.m. on the 2nd day of June, 1980, and it appearing fur-
ther that the granting of said petition for the vacation of said
street will not be a menace or inconvenience to the traveling
public or to any other persons using the streets and alleys of
the City of Kent, Washington,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The following described street within the
city limits of Kent, Washington, and which is more fully described
(SAID INSTRUMENT IS BEING RE-RECORDED TO CORRECT ERROR IN LEGAL DESCRIPTION)
therewith:
All of Helen Street located in Strain's First
Addition as recorded in Volume 65 of Plats,
Page 93, records of King County, Washington,
EXCEPT those portions lying within the Valley
Freeway.
is hereby vacated, reserving, however, any necessary easements for
futilities and storm drainage and a 20 foot wide vehicular access
easement to Lots 7,8,9 and 10 on the north side of Helen Street
and Lots 14and15 on the south side of Helen Street.
Section 2. No vested rights shall be affected by the
provisions of this Ordinance.
Section 3. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and pub-
lication as provided by law.
