ORDINANCE NO. cl:;Pc,
AN ORDINANCE of the City of Kent,
Washington, relating to planning and re-
zoning for land development a portion of
certain property originally zoned by the
City of Kent as HC (Highway Commercial)
to CM (Commercial Manufacturing) zone.
(MIDWAY EQUIPMENT REZONE)
WHEREAS certain land was zoned by the City of Kent by
Ordinance 1827 entitled "Ordinance Adopting Zoning Code for the
City of Kent, Washington" on the 4th day of June, 1973; and
WHEREAS the effective date of the zoning of said land
by said Ordinance 1827 and the effective date of said Ordinance
1827 itself, was the 20th day of June, 1973; and
WHEREAS as required by Ordinance 1827 and by Ordinance
2180, a public hearing was held before the Hearing Examiner of
the City of Kent, wherein it was recommended that said land be
rezoned; and
WHEREAS thereafter the City Council of the City of
Kent, following review of the findings and conclusions of the
Hearing Examiner, did on the 21st day of January, 1980 consider
said findings and recommendations at a regular public meeting and
concurring with the findings and recommendations of the Hearing
Examiner determined the land should be rezoned to CM (Commercial
Manufacturing) zone; and
WHEREAS it is found that the rezone of land is in the
best interest of the health and welfare of the citizens of the
City of Kent and is consistent with the Comprehensive Plan of the
City of Kent and consistent with good planning, NOW, THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
HEREBY ORDAIN AS FOLLOWS:
Section 1. The following described land situated in
the City of Kent, King County, State of Washington and presently
zoned as HC (Highway Commercial) and more particularly described
as follows:
That portion of Shinn's Garden addition to
Kent according to the plat recorded in Vol-
ume 8 of Plats, Page 1, in King County,

Washington, as follows:
Beginning at the southwest corner of
Government Lot No. 1, Section 18,
Township 22 North, Range 5 East, W.M.,
in King County, Washington, thence north
1007'42" east along the west ling of
said Section 18 a distance of 289 feet;
thence north 89045141" east parallel
with the south line of Government Lot
1 a distance of 350 feet; thence south
1°07'42" west to the northerly line of
the frontage service road as condemned
in King County Superior Court Cause No.
587053 and also conveyed to the public
for road purposes by instrument record-
ed under Auditor's File No. 5543436;
thence westerly along said northerly
line to the easterly line of Primary
State Highway No. 5 as condemned in
King County Superior Court Cause No.
587053; thence south 89145141" west to
the west line of Government Lot No. 2
in said Section 18; thence north 1107'42"
east to the point of beginning; except that
portion thereof lying westerly of the
easterly line of said Primary State High-
way No. 5.
is hereby rezoned to CM (Commercial Manufacturing) zone.
Section 2. The Planning Director of the City of Kent
be and he is hereby authorized and directed to indicate upon the
Comprehensive Zoning Map of the City of Kent or upon an addendum
thereto, the zoning of said property as provided for in Section 1
of this Ordinance.
Section 3. That upon said amendment being shown upon
the Comprehensive Zoning Map of the City of Kent or upon an ad-
dendum thereto, the copy of said map or addendum, shall be filed
with the Director of Records and Elections of King County Washing-
ton, and the City Clerk of the City of Kent be and she hereby is
authorized and directed to record this ordinance with the County
Auditor of King County and pay the filing fee therefore.
Section 4. This Ordinance shall take effect and be
in force five (5) days from and after its passage, approval and
publication as provided by law.
