ORDINANCE NO. :2W26.t7
AN ORDINANCE of the City of Kent,
Washington, imposing an assessment against
certain properties in the City of Kent for
the purpose of defraying the costs of the
Kent Valley Studies Program.
WHEREAS the City of Kent has commissioned certain
studies to determine the impact of development within the MA and
RA zoned areas of the City, and

WHEREAS the cost of said studies to the City of Kent
is $263,000 and it has been determined that the costs of the stud
should be borne proportionally by those properties within the
study area, and
WHEREAS Ordinance 2164 as amended by Ordinance 2192
of the City of Kent requires owners or developers of property
wishing to have property rezoned from MA or RA to some higher
zoning classification to pay their proportional share of
the cost of the studies prior to processing of said rezones,
NOW, THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON,
DO HEREBY ORDAIN AS FOLLOWS:
Section 1. There is hereby imposed, in the nature
of a charge in lieu of assessment, a charge against all
properties in the City of Kent zoned MA or RA as of May 21,
1979.
Section 2. The purpose of the charge imposed in
Section 1 is to reimburse the City of Kent for the cost of
certain studies commissioned by the City and commonly called
the "Kent Valley Studies Program."
Section 3. The charge to be imposed shall be based
upon acreage and shall not exceed $130 per acre.

Section 4. The charge imposed shall be payable upon
either of the following occurences:
a) For those properties currently zoned MA
and RA, at the time of application for
change to some higher zoning classification.
b) For those properties, the zoning of which
was MA or RA as of May 21, 1979, but which
have subsequently been changed to some other
zoning classification, at the time of appli-
cation for building or other development
permit.
Section 5. This Ordinance shall take effect and be
in force five days after its passage, approval and publication
as required by law.
