AN ORDINANCE of the City of Kent,
Washington, relating to unauthorized
parking in handicapped parking zones,
amending Section 10.06.23 Kent City Code
(Ordinance 2406) to refer to RCW
46.16.381.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. KCC 10.06.23 is amended as follows:
(a) It is a traffic infraction for any person to park a
vehicle in a parking place reserved for physically disabled
persons pursuant to Chapter RCW 70.92, or authority implemental
thereof, without a special license plate, card or decal as
provided in RCW ((46.±6:0-) 46.16.381, as amended. This
provision shall be enforceable on private property open to the
general public as well as on streets and government owned
property. A person charged with a violation shall not be
determined to have committed an infraction if he or she produces
in court or prior to the court appearance a special license plate,
special card, or special decal required by RCW 6-368)-)/
46.16.381 or demonstrates he or she was entitled to the same at
the time of being ticketed.
(b) Penalty. Any violation of this Section 10.06.23(a)
shall be an infraction and punishable by a monetary penalty of not
more than one hundred dollars. The recommended bail for such a
violation shall be that bail approved for "Unauthorized parking in
handicap zone - RCW 46.61.580." Vehicles in violation are also
subject to impoundment as provided by law.
Section 2. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
