ORDINANCE NO.
AN ORDINANCE of the City of Kent,
Washington, vacating a portion of S. 212th St.
lying between 84th Ave. So. and the Valley
Freeway also known as State Route 167, and more
commonly known as the Bowen Street vacation.
WHEREAS, proper application was filed with the City of
Kent for the vacation of a dedicated public alley of the City; and
WHEREAS, the Kent City Council did by resolution, fix a
time when said petition would be heard, and said hearing was held
on proper notice on January 5, 1987 at the hour of 7:00 p.m. in
the Council Chambers of the City Hall of the City of Kent,
Washington; and
ii WHEREAS, the petition was processed by the Kent Planning
Director and the Department of Public Works and necessary
technical facts pertinent to the question of said vacation was
,provided by affected departments; and
WHEREAS, it appears that the granting of said petition
(would not be a menace or inconvenience to the traveling public or
to any other person using the streets or alleys of the City of
'Kent, Washington; and
WHEREAS, the City Council directed the preparation of an
Ordinance vacating said street on certain conditions as set forth
herein; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. That portion of roadway within the City of
Kent as more fully described as follows:
That portion of the Northwest quarter of
Section 7, Township 22 North, Range 5 East,
W.M., King County, Washington, more particularly
described as follows:
Commencing at the Northwest corner of Lot 3 of
City of Kent Short Plat SP -85-1, as recorded in
the records of King County under Recording No.
8506201013;
THENCE North 89057105" East, 39.97 along the
North line of said Lot 3 and the South margin of
South 212th Street, feet to the TRUE POINT OF
BEGINNING;
THENCE continuing North 89057105" East, 130.62
feet along a line parallel with and 45.00 feet
southerly of the centerline of South 212th
Street, to an intersection with the East line of
said Lot 3 projected Northerly;
THENCE South 01015'10" West, 60.02 feet along
said projected East line, to the Northeast
corner of said Lot 3'
THENCE South 89057'05" West, 35.01 feet along
the Northerly line of said Lot 3;
THENCE North 44041116" West, 70.27 feet along
the Northeasterly line of said Lot 3;
THENCE North 77029101" West, 45.97 feet along
the Northerly line of said Lot 3 to an
Intersection with the existing South margin of
South 212th Street and the TRUE POINT OF
BEGINNING; except the North 5.00 feet thereof.
is hereby vacated; reserving, however, onto the City of Kent,
utility easements over the vacated portion of the right-of-way
including the right to grant utility easement rights to others
such as telephone company, gas company, and cable TV company.
Section 2. No vested rights shall be effected by the
provisions of this ordinance.
Section 3. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
