O AN ORDINANCE of the City of Kent, Washington, relating to utilities; repealing Ordinance No. 2671; providing for the continuation of the Kent Garbage Utility on and after January 1, 1987. WHEREAS, on October 20, 1986, the City Council of the City of Kent, Washington adopted Ordinance No. 2671 which added a new Section 7.02.200 to the Kent City Code; and WHEREAS, Ordinance No. 2671 and Section KCC 7.02.200 provided for the discontinuance of the City of Kent Garbage Utility, effective January 1, 1987; and WHEREAS the City has determined to continue the garbage utility on and after January 1, 1987; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY ORDAIN as follows: Section 1. Ordinance No. 2671, and KCC 7.02.200 created thereby, are hereby repealed. The City of Kent Garbage (solid waste) Utility is hereby continued on and after January 1, 1987, pursuant to RCW 35.21.120 and 35.67.020, as a system and plant for garbage and refuse collection and disposal, and such garbage utility shall be maintained by the City separate and distinct from the system of sewerage ("combined sewer utility") provided for in KCC 7.03.010. Section 2. No vested rights shall be created by this ordinance. Section 3. This ordinance shall take effect and be enforced five days from and after its passage, approval and publication as provided by law. ATTEST: MARIE JENSEN, CITY CLERK APPROVED AS TO FORM: BILL H.
