AN ORDINANCE of the City of Kent,
Washington relating to construction and land
development; adding new Sections 14.04.100 and
15.09.300 Kent City Code to identify
responsibility for the location of lot lines
and/or setback lines.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. A new Section 14.04.100 Kent City Code is
added as follows:
14.04.100. LOT LINES AND SETBACK LINES.
Notwithstanding the authority of the Building Official to
administer and enforce the Building Code, the Building Official
shall have no duty to verify or establish lot lines or setback
lines, and no such duty is created by this chapter, and none shall
be implied. The location of lot lines and/or setback lines at a
development and construction related thereto shall be the
responsibility of the applicant/owner.
Section 2. A new Section 15.09.300 Kent City Code is
added as follows:
15.09.300 LOT LINES AND SETBACK LINES.
Notwithstanding any provisions in this Title 15 to the
contrary, the City of Kent shall have no duty to verify or
establish lot lines on setback lines at a development. The
location of lot lines and/or setback lines at a development and
construction related thereto shall be the responsibility of the
applicant/owner.
Section 3. Any act consistent with the authority and
prior to the effective date of this ordinance is hereby ratified
and confirmed.
Section 4. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
