AN ORDINANCE of the City of Kent,
Washington, providing for the acquisition oF'dO

certain properties for the improvement of -tie
combined sewerage utility, a part of which''is
the storm and surface water utility, for the
purpose of draining swamps, marshes, or ponds,
or filling the same and for such other purposes
consistent with the City of Kent's Storm and
Surface Water Utility, and Drainage Master
Plan; providing for the condemnation,
appropriation, taking and damaging of land and
other property rights necessary therefor; all
located within portions of the southeast
quarter of Section 11, Township 22 North, Range
4 East, W.M. in King County, Washington, and
also within portions of the southwest quarter
of Section 12, Township 22 North, Range 4 East,
W.M., and also within portions of the southeast
quarter of Section 18, Township 22 North, Range
5 East, W.M., in King County, Washington.
THE CITY OF KENT, WASHINGTON DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. The public convenience, use aria necessity
demand that the following described real property in King County,
Washington be and the same is hereby condemned, and the City will
acquire the fee interest of certain properties herein designated,
for the improvement of the combined sewerage utility, a part of
which is the storm and surface water utility, for the purpose of
draining swamps, marshes or ponds, or filling the same, and for

such other purposes consistent with the City of Kent s Storm and
Surface Water Utility, and Drainage Master Plan, to -wit:
The description of Parcels 90245, 90246, 90249, 90250 and!
90252 is attached hereto and incorporated herein by this referencel.
Section 2. All lands, rights, privileges and other
property lying within the limits of the lots, blocks and tracts of
land described in Section 1 hereof are hereby condemned,
appropriated, taken and damaged for the purpose of improving the
combined sewerage utility, a part of which is the storm and

surface water utility, and other public use and all lands, rights,
privileges and other properties are to be taken, damaged and
appropriated only after just compensation has been made, or paid
into court for the owners thereof in a manner provided by law.
Section 3. The entire cost of the improvement and
acquisition provided by this Ordinance shall be paid from the
Utility Fund, or from such General Funds of the City of Kent as
may be provided by law.
Section 4. The City Attorney be and he is hereby
authorized and directed to begin and prosecute the actions and
proceedings in the manner provided by law to condemn, take, damage
and appropriate the lands and other property necessary to carry
out provisions of this Ordinance. In conducting said condemnation
proceedings, the City Attorney is hereby authorized to enter into
stipulations for the purpose of minimizing damages; such
stipulations to include, but not limited to, size and dimensions
of the taking, construction easements and other property interests
Section 5. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
