AN ORDINANCE of the City of Kent,
Washington, relating to local improvement
district foreclosures; adding new Section
3.20.040(A) to change the mailing date of
foreclosure notices for 1986, and amending Kent
City Code Section 3.20.050 (Ordinance No. 2563)
to change the time period when foreclosure
actions may be commenced.
WHEREAS, the Finance Department has been reorganized and
the Treasurer's Office is understaffed; and
WHEREAS, local improvement district foreclosure notices
have not been sent out by July 1 as set forth in KCC 3.20.040; and
WHEREAS, it is necessary to change the date for mailing
foreclosure notices, and the period for commencing foreclosure
proceedings; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Section 3.20.040(A) Kent City Code is added
as follows:
3.20.040(A). NOTICE OF DELINQUENT ASSESSMENTS. It shall
be the duty of the City Treasurer on or before the first day of
September of 1986 to notify by certified mail, 30 days before the
commencement of foreclosure proceedings, the persons whose names
appear on the assessment roll as the owners of the property
charged with assessments or installments which are more than two
years delinquent on the first day of January preceding, or for
which the final installment has been delinquent since the first
day of January of the preceding year, for the purpose of
foreclosing the delinquent assessment or delinquent installments,
as provided by Chapter 35.50 RCW. If the person whose name
appears on the tax rolls of the County Assessor as the owner of
the property, or the address shown for the owner on such rolls,
differs from that appearing on the City assessment roll, then the
City Treasurer shall also mail a copy of the notice to that person
or that address. The notice shall state the amount due upon each
separate lot, tract, or parcel of land and the date after which
proceedings to foreclose will be commenced. This section
3.20.040(A) replaces KCC 3.20.040 in 1986, thereafter KCC 3.20.040
shall have full force and effect. This section 3.20.04(A) shall
be null and void on January 1, 1987.
Section 2. Section 3.20.050 Kent City Code (Ordinance
2563) is amended as follows:
3.20.50. FORECLOSURE OF DELINQUENT ASSESSMENTS. When
any local improvement district or utility local improvement
district assessment is payable in installments, upon failure to
pay any installment due, the assessment shall be immediately due
and payable and the collection thereof shall be enforced by
foreclosure. The payment of all delinquent installments together
with interest, penalty and costs at any time before the entry of
judgment and foreclosure shall extend the time of payment on the
remainder of the assessment installments as if there had been no
delinquency or foreclosure. Foreclosure proceedings may be
commenced at any time H-pEieE to August fit-) on or before
October 15 of the year in which, on the first day of January of
such year two installments of any local improvement district or
utility local improvement district assessment were delinquent or
the final installment was delinquent for more than one year. In
case of foreclosure, there shall be added to the cost and expenses
provided by Chapter 35.50 RCW, such reasonable attorney's fees as
the court may be adjudged to be equitable, and the amount thereof
shall be apportioned to each delinquent assessment or installment
appearing on that roll. When one or more delinquent installments ,
are paid before the foreclosure proceedings are completed, payment
of such costs shall be a prerequisite to the City's dismissal of
such proceedings unless otherwise ordered by the court.

Section 3. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
