ORDINANCE NO.
AN ORDINANCE of the City of Kent,
Washington, vacating a portion of 80th Place
South, south of 180th Street (Southwest 43rd
Street) in the City of Kent, and more
particularly described herein. [Petition of
Burlington Northern and Mannesman Talley)
WHEREAS, a proper application was filed with the City of
Kent for the vacation of a dedicated public street of the City;
and
WHEREAS, the Kent City Council did by Resolution 1089 on
January 21, 1986 fix a time when said application would be heard,
and said hearing was held, on proper notice, on February 18, 1986
at the hour of 7 o'clock p.m. in the Council Chambers of the City
Hall of the City of Kent, Washington; and
WHEREAS, the Kent Planning Director and Director of the
Department of Public Works processed said application and secured
technical facts pertinent to the question of said vacation which
includes a sketch of the proposed vacation and written reports
with respect to water, sewer, and streets of the City; and
WHEREAS, it appeared that granting of the said
application would not be a menace or inconvenience to the
traveling public or to any other person using the streets or
alleys of the City of Kent, Washington; and
WHEREAS, the Council approved the grant of the street
vacation on certain conditions, as specified herein, NOW, THEREFOR
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. That portion of 80th Place S. within the City
limits of Kent, Washington and more fully described in Appendix A,
attached hereto and incorporated herein by this reference, is
hereby vacated. The vacation is subject to and conditioned on the
following:
A. The City shall retain a utility easement over
that portion of 80th Place South, hereby vacated, and shall have
the right to authorize other utilities use thereof. Upon
confirmation by the Public Works Director that no utilities

(public or private) exist within said reserved easement, the
Director may release all or any portion thereof to the petitioners.
B. 80th Place South is classified as a Class B
street and pursuant to Ordinance 2333, the petitioners shall
compensate the City of Kent for one-half the appraised value of
that portion of 80th Place South hereby vacated.
Section 2. Any act consistent with the authority and
prior to the effective date of this ordinance is hereby ratified
and confirmed.
Section 3. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.

the NE 1/4 of Section 36, T 23 N, R 4 E, W.M., in King County,
Washington being described as follows:

rte.. S 0200514111 W, along the east line of said subdivision, a distance of
0 30.00 feet to the southerly margin of SW 43rd St. (S 180th St.);
Thence N 87056140" W, along said margin a distance of 301.17 feet;

8602120324; Thence N 88010132" W, along said northerly line, a
distance of 24.02 feet; Thence N 49032105" W, 15.00 feet
