AN ORDINANCE of the City of Kent,
Washington, relating to street vacations,
amending Ordinance 2402 to allow additional
driveway access.

WHEREAS, by Ordinance 2402, that portion of South 202nd
Street within the City limits, more fully described as:
That portion of South 202nd Street lying
west of Puget Power Right -of -Way, east of 72nd
Avenue South and lying between lots 15 and 16
in Volume 15 of plats, page 66 King County,
Washington.
was vacated, RESERVING an easement for drainage, and overhead or
underground utilities in the westerly ten feet of said portion of,
South 202nd Street, and imposing certain conditions; and
WHEREAS, upon the request of the property owner and after,,
due consideration, it is deemed appropriate to amend those
conditions to allow additional driveway access; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:

Section 1. Section 1 of Ordinance 2402 is hereby amended
to read as follows:
That portion of South 202nd Street within the City Limit
of Kent, Washington, and more fully described as follows:
That portion of South 202nd Street lying
west of Puget Power Right -of -Way, east of 72nd
Avenue South and lying between lots 15 and 16
O'Brien Station Garden Tracts No. 2 as recorded
in Volume 15 of plats, page 66 King County,
Washington.
is hereby vacated, RESERVING, however, an easement for drainage,
and overhead or underground utilities in the westerly ten feet of
said portion of South 202nd Street. This vacation is further
conditioned on the following:
Access to lots 15 and 16 of O'Brien
Station Garden Tracts No. 2 shall be limited to

those driveways which are approved in
accordance with the development review process.
Section 2. No vested rights shall be affected by the
provisions of this ordinance.
Section 3. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
