OC IP O 86/03/18 #0724 RECD F 10.00 CigSHSL *:**10.00 55 AN ORDINANCE of the City of Kent, Washington, providing for the acquisition of certain properties for the improvement of the municipal water system, a system of aqueducts, reservoirs, pumping stations and other structures for conveying into and through the City of Kent a supply of fresh water, and for the purpose of protecting such supply of fresh water from pollution; providing for the condemnation, appropriation, taking and damaging of land and other property rights necessary therefore; all located between S.E. 271st Street and S.E. 274th Street at 108th Avenue S.E. in King County, Washington. [In Re Kent Springs Transmission Main.] THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The public convenience, use and necessity demand that the following described real property in King County, Washington be and the same is hereby condemned for the improvement of the municipal water system, a system of aqueducts, reservoirs, pumping stations and other structures and appurtenances for conveying into and through the City of Kent supply of fresh water, and for the purpose of protecting such supply of fresh water from pollution. In the condemnation of the property described below for the improvement of the municipal water system, and for general municipal purposes, the City shall acquire permanent easements and temporary construction easement as hereinafter described, to -wit: 1.1 [Parcel 934931 1.1.1 Whole Property Description: Lot 4, King County Short Plat No. 677086 recorded under Recording No. 7807070662, In Section 29, Township 22 North, Range 5 East, W.M., in King County, Washington. 1.1.2 Permanent Easement: That portion of Lot 4, King County Short Plat No. 677086 recorded under Recording No. 7807070662 in Section 29, Township 22 North, Range 5 East, W.M., in King County, Washington, described as follows: Nr CV C CD t") n m A strip of land 25 feet in width lying within said Lot 4 the center line of which strip is described as follows: Beginning at the southwest corner of said Lot 4; thence northerly along the west line thereof, a distance of 112.87 feet to the TRUE POINT OF BEGINNING of center line hereafter described; thence south 36041135" east, a distance of 142.20 feet more or less to a point on the south line of said lot being the terminus of said center line. Containing 3,555 square feet, more or less. 1.1.3 Temporary Construction Easement: That portion of Lot 4, King County Short Plat 677086, recorded under Recording No. 7807070662 and lying within a portion of the southwest quarter of the southeast quarter in Section 29, Township 22 North, Range 5 East, W.M., King County, Washington, described as follows: Two strips of land 25 feet in width lying within said Lot 4 the center line of which strips are described as follows Beginning at the southwest corner of said Lot 4; thence northerly along the west line thereof, a distance of 70.55 feet to the TRUE POINT OF BEGINNING of center line of first strip; thence south 36041135" east, a distance of 88.89 feet more or less to a point on the south line of said lot being the terminus of center line herein described. AND the other strip of land 25 feet in width lying within said Lot 4, the center line of which strip is described as follows: Beginning at the southwest corner of said Lot 4; thence northerly along the west line thereof, a distance of 155.18 feet to the TRUE POINT OF BEGINNING of center line of second strip; thence south 36041135" east, a distance of 195.51 feet more or less to a point on the south line of said lot being the terminus of center line herein described. Containing 7,110 square feet, more or less. 1.2 [Parcel 934941 1.2.1 Whole Property: The west half of the northwest quarter of the northwest quarter of the northeast quarter of Section 32, Township 22 North, - 2 - 4cr r C 00 O 00 Range 5 East, W.M., in King County, Washington; except the south 382 feet thereof; and except county road. 1.2.2 Permanent Easement: A strip of land 25.00 feet in width lying within a portion of the west half of the northwest quarter of northwest quarter or northeast quarter in Section 32, Township 22 North, Range 5 East, W.M., King County, Washington, except the south 382.00 feet and except county roads: Beginning at the northwest corner of the above-described property thence east along the north line thereof, a distance of 84.03 feet to the TRUE POINT OF BEGINNING of center line of said strip; thence south 36141135" east, a distance of 314.92 feet more or less to a point on the east line of said property being the terminus of center line herein described. Containing 7,873 square feet, more or less. 1.2.3 Temporary Construction Easement: Two strips of land 25.00 feet in width lying within a portion of the west half of the northwest quarter of the northwest quarter of the northeast quarter in Section 32, Township 22 North, Range 5 East, W.M., King County, Washington, except the south 382.00 feet and except county roads, described as follows: Beginning at the northwest corner of the above-described property; thence east along the north line thereof, a distance of 52.53 feet to the TRUE POINT OF BEGINNING of center line of first strip; thence south 36041135" east, a distance of 341.10 feet more or less to a point on the south line of said property being the terminus of center line herein described. AND the other strip of land 25.00 feet in width: Beginning at the northwest corner of said above described property; thence east along the north line thereof, a distance of 115.54 feet to the TRUE POINT OF BEGINNING of center line of second strip; thence south 36041135" east, a distance of 264.79 feet more or less to a point on the east line of said property being the terminus of center line herein described. Containing 15,146 square feet. - 3 - N C) 0 00 1.3 [Parcel 934951 1.3.1 Whole Property Description: The east half of the northwest quarter of the northwest quarter of the northeast quarter of Section 32, Township 22 North, Range 5 East, W.P., in King County, Washington, except county roads. 1.3.2 Permanent Easement: A strip of land 25 feet in width lying within a portion of the east half of the northwest quarter of the northwest quarter of the northeast quarter of Section 32, Township 22 North, Range 5 East, W.M., King County, Washington, except roads, described as follows: eginning at the southwest corner of the above-described property; thence north along the west line thereof, a distance of 382.92 feet being the TRUE POINT OF BEGINNING of center line herein described; thence south 22031153" seconds east, a distance of 417.67 feet more or less to a point on the south line of the above-described property being the terminus of center line herein described. Containing 10,442 square feet. 1.3.3 Temporary Construction Easement: Two strips of land 25 feet in width lying within a portion of the east half of the northwest quarter of the northwest quarter of the northeast quarter of Section 32, Township 22 North, Range 5 East, W.M., King County, Washington, except roads, described as follows: Beginning at the southwest corner of the above-described property; thence north along the west line thereof, a distance of 323.24 feet being the TRUE POINT OF BEGINNING of center line of first strip; thence south 22031153" east, a distance of 352.58 feet more or less to a point on the south line of the above-described property being the terminus of center line herein described; AND the other strip of land 25.00 feet in width: Beginning at the southwest corner of said above-described property; thence north along the west line thereof, a distance of 422.71 feet being the TRUE POINT OF BEGINNING of center line of second strip; thence south 36041135" east, a distance of - 4 - N C _CC) M O CO 34.06 feet; thence south 22031153" east, a distance of 431.68 feet more or less to a point on the south line of the above-described property being the terminus of center line herein described. Containing 20,405 square feet. Section 2. All lands, rights, privileges and other property lying within the limits of the lots, blocks, and tracts of land described in Section 1 hereof are hereby condemned, appropriated, taken and damaged for the purpose of improving the municipal water system and other public use and lands, rights, privileges and other properties are to be taken, damaged and appropriated only after just compensation has been made, or paid into court for the owners thereof in a manner provided by law. Section 3. That the entire cost of the improvement acquisition provided for by this ordinance shall be paid from the Water Utility Fund, or from such general funds of the City of Kent as may be provided by law. Section 4. The City Attorney be and he is hereby authorized and directed to begin and prosecute the actions and proceedings in a manner provided by law to condemn, take, damage and appropriate the lands and other property necessary to carry out the provisions of this ordinance. Section 5. In conducting said condemnation proceedings, the City Attorney is hereby authorized to enter into stipulations for the purpose of minimizing damages; such stipulations to include, but not be limited to, size and dimensions of the taking, construction easements and other property interests. Section 6. Effective Date.
