HomeMy WebLinkAbout2598ORDINANCE NO. .��& AN ORDINANCE of the City Council of the City of Kent, Washington, relating to property; authorizing an exchange of certain property with the Andover Company in Block 1 of the Southcenter Corporate Park, Volume 114 of Plats, Pages 36-42 inclusive, Records of King County, Washington, to facilitate access and use of the Green River Corridor Trail; authorizing acceptance of the deed evidencing the property exchanged to the City; granting the Andover Company, its successors and assigns, the nonexclusive property right to use up to twelve parking spaces in the City parking facility to be provided hereby; setting forth other conditions of the property exchange. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON AS FOLLOWS: Section 1. Recitals. The City owns certain property in Block 1 of the Southcenter Corporate Park, Volume 114 of Plats, pages 36-42 inclusive, Records of King County, Washington. The City has intended to develop such property for parking and access, to facilitate use of adjoining Green River Trail system. 1.2 The Andover Company has property abutting the City property, identified in Section 1.1, above. In order to facilitate development of their property, and to provide for development of access to the Green River Corridor Trail, the Andover Company has offered to exchange certain part of its property, for City of Kent property. The Andover Company is further willing to develop, construct, and pay for the City parking lot, and attendant landscaping, to City standards, for the public use. 1.3 The City Council reviewed this matter, upon the recommendation of the Parks Committee, at the regular City Council meeting of October 7, 1985. At the October 7 meeting, the Council approved the proposed exchange , and authorized this ordinance. Section 2. Property Exchange. 2.1 The City of Kent does hereby grant, and authorizes the Mayor to execute a quit claim deed for Tract "C," in Block 1, Southcenter Corporate Park as shown recorded in Volume 114 of Plats, pages 36-42 inclusive; containing 13,550 square feet more or less. to the Andover Company, its successors and assigns. The grant herein is in consideration for the grant of The northwesterly 65.1 feet of Lot 10, Block 1, Southcenter Corporate Park as recorded in Volume 114 of Plats, pages 36-42 inclusive, as measured at right angles to the northwesterly line thereof, and containing 11,850 square feet more or less. to the City of Kent. The grant and exchange provided for herein is further conditioned on the provisions set forth in paragraph 2.1 below. 2.1 The Andover Company, its successors and assigns, shall be responsible for the construction and all costs associates with the development and construction of a parking lot on the property exchanged to the City of Kent, above described, to norma] City standards, and including attendant landscaping. The City hereby grants to the Andover Company, its successors and assigns, the nonexclusive property right to use up to twelve parking space: on the property exchanged to the City of Kent pursuant to this ordinance, and the deed evidencing the grant to the City of Kent may contain a reservation of such a right by the grantor to said twelve parking spaces. Section 3. The Mayor is authorized to execute necessary documents for the purposes of this ordinance. Section 4. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and confirmed. Section 5. Effective Date.
