AN ORDINANCE of the City of Kent, Washington, relating to park property; accepting a donation of property from Vincenzo DiPietro, and from Victor DiPietro as personal representatives of the estate of Incoronata DiPietro; authorizing acceptance of deeds; authorizing a monument acknowledging the donation of the property. THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. RECITALS. 1.1 In connection with the sale of certain property to Upland Industries Corporation, Victor DiPietro as personal representative of the estate of Incoronata DiPietro, and Vincenzo DiPietro have offered to donate to the City of Kent approximately .9124 acre of property adjacent to and north of the Van Doren Landing Park along the Green River and Russell Road in the City of Kent. 1.2 Easements for underground utilities are to be reserved to the grantor. 1.3 Access easements are not reserved or otherwise provided, in that remaining property is to be sold to Upland Industries Company. Such sale constitutes a unification of title and use with existing Upland property, and access shall be provided over and through such existing property. 1.4 A monument, as provided herein, shall be manufactured, installed and maintained to acknowledge the generous donation of the DiPietro property to the City of Kent. Section 2. ACCEPTANCE. The QUIT CLAIM DEED (Vincenzo DiPietro) [Vincenzo DiPietro, Grantor], and the QUIT CLAIM DEED (Estate) [Victor DiPietro as personal representative of the estate of Incoronata DiPietro, Grantor] copies of which are attached hereto and incorporated herein by this reference be and the same ,re hereby accepted by the City of Kent for general municipal )urposes. The property conveyed by said DEEDS shall be and the >ame is hereby assigned to the Department of Parks and Recreation :or purposes of the Green River parks and trail system. gaoi-inn 3. MONUMENT AUTHORIZED. 3.1 One ten inch by twelve inch (10" x 12") engraved bronze plaque, to read "DONATED BY VINCENZO AND INCORONATA DiPIETRO," shall be placed in the center of an eighteen inch by twenty inch (18" x 20") concrete pad at ground level on the donated property. The Parks Department shall maintain the monument, and keep it visible at all times. 3.2 The Parks Department is authorized to expend funds in the Parks Department budget for construction of the monument identified in Section 3.1, above. Section 4. Effective Date. This ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as provided by law.
