AN ORDINANCE of the City of Kent,
Washington, vacating a portion of an alley lying
between State Street and Kennebeck Street, and
Smith Street and McMillan Street and more
particularly described as that certain portion of
alley lying within block 19, Washington Central
Improvement Company's First Addition to Kent, as
recorded in Volume 3 of Plats, Page 97 in King
County, Washington, which portion lies between
Lots 1 through 7 and Lots 16 through 22, on
certain conditions. [Application of Group 71.
WHEREAS, proper application was filed with the City of
Kent for the vacation of a dedicated public alley of the City; and
WHEREAS, the Kent City Council did by Resolution 1065,
fix a time when said petition would be heard, and said hearing was
held on proper notice on July 15, 1985 at the hour of 7:00 p.m. in
the Council Chambers of the City Hall of the City of Kent,
Washington; and
WHEREAS, the petition was processed by the Kent Planning
Director and the Department of Public Works and necessary
technical facts pertinent to the question of said vacation was
provided by affected departments; and
WHEREAS, it appears that the granting of said petition
would not be a menace or inconvenience to the traveling public or
to any other person using the streets or alleys of the City of
Kent, Washington; and
WHEREAS, the City Council directed the preparation of an
Ordinance vacating said street on certain conditions as set forth
herein; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. That portion of an alley between Smith and

McMillan Street, and between State Street and Kennebeck Street;
more particularly described as follows:
That certain portion of alley lying within block
19, Washington Central Improvement Company's
First Addition to Kent, as recorded in Volume 3
of Plats, Page 97 records of King County,
Washington, which portion lies between Lots 1
through 7, and Lots 16 through 22 of said
Washington Central Improvement Company's First
Addition.
is hereby vacated; reserving, however, onto the City of Kent, a
sanitary and sewer easement which area reserved lies within said
block 19, between Lots 4 through 7, and Lots 16 through 19. Any
remaining portion of said alley shall be unencumbered. Providing
further, that as a condition for said vacation, the applicant
shall deed to the City for street purposes as compensation for the
vacation, that property set forth, and more particularly described
in, Exhibit A, attached hereto. Said property required to be
deeded is 1,155 square feet. Such dedication to substitute, and
compensate for the alley vacation, pursuant to Ordinance 2333.
Section 2. No vested rights shall be effected by the
provisions of this ordinance.
Section 3. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
