AN ORDINANCE of the City of Kent, Washing-
ton, relating to Finance and Personnel; author-
izing the settlement in the matter of William
N.`Nirk; Court of Appeals Cause Numbers
8361-9-I, 12700-4-I, and 16063-0-I; authorizing
the appropriation of X250,000 from the Contin-
gency Fund for purposes of said settlement;
authorizing the City Attorney to prepare and
execute necessary legal documents in
furtherance thereof.
WHEREAS, the matter of the discharge of William N. Nirk
has been the subject of a decade of litigation; and
WHEREAS, two matters are currently pending in Division I
of the Washington State Court of Appeals under Cause Numbers
12700-4-I, and 16063-0-I; and
WHEREAS, the matter has been reviewed by the Office of
the City Attorney, and further reviewed by outside counsel
separately retained by the City to advise it with regard to the
merits of the proceedings; and
WHEREAS, the City Council of the City of Kent determines
that it is in the best interests of the City to settle the matter
by payment of a fixed sum to William N. Nirk, and to not authorize
reinstatement; NOW THEREFORE
THE CI`T'Y COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. The City Attorney be and he is hereby
authorized to prepare and execute necessary legal documents for
the settlement of the matter of Nirk v. Kent Civil Service
Commission, also known as City of Kent v. Nirk, Court of Appeals
Cause Numbers 8361-9-I, 12700-4-I, and 16063-0-I.
Section 2. $250,000 is hereby appropriated from the
unexpended and unencumbered funds in the Contingency Fund, and the
City Treasurer is authorized to execute the necessary warrants in
furtherance of the settlement authorized hereby.
Section 3. Any act consistent with the authority and
prior to the effective date of this ordinance is hereby ratified
and confirmed.
Section 4. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
