AN ORDINANCE of the City of Kent,
Washington, relating to plats, setting aside
the vacation of Strain's First Addition, to the
City of Kent.
WHEREAS, on petition properly received, the Kent City
Council on July 7, 1980, adopted Resolution 902 which set
August 4, 1980 for a hearing on the vacation of Strain's First
Addition Plat; and
WHEREAS, on August 4, 1980, said hearing was conducted or
proper notice; and
WHEREAS, the Kent City Council approved, with conditions,
the plat vacation; said conditions being:
1. Grant to the City an easement for utility and
drainage purposes on the westerly 15 feet of Lot 6, 7, and 15 of
Strain's First Addition as recorded in Volume 65 of Plats, Page
93, Records of King County, Washington.
2. Grant to the City a Temporary Construction
Easement on the easterly 20 feet of the westerly 35 feet of Lot 6,
7, and 15 of Strain's First Addition as recorded in Volume 65 of
Plats, Page 93, Records of King County, Washington; And
WHEREAS, the conditions for Plat vacation were met, but
the plat remains of record; and
WHEREAS, the current Plat owner wishes to transfer
interests in the lots in Strain's First Addition; and
WHEREAS, transfer of such lots will not be permitted
until such time as the vacation is set aside; and
WHEREAS, the City of Kent having determined that said
vacation should be set aside; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:

Section 1. The vacation of Strain's First Addition,
recorded in Volume 65 or Plats, Page 93, Records of King County,
Washington, by the Kent City Council on August 4, 1980, be and the
same is hereby set aside, and said Strain's First Addition is
hereby reinstituted.
Section 2. The setting aside of the vacation of Strain'si
First Addition Plat, as provided for in Section 1, above, is
expressly conditioned upon:
1. The payment of $4,060.38 to the City of Kent for
LID 299.
2. Retention by the City of an easement for utility
and drainage purposes on the westerly 15 feet of Lot 6, 7, and 15
of Strain's First Addition as recorded in Volume 65 of Plats, Page
93, Records of King County, Washington.
Section 3. Any act consistent with the authority and
prior to the effective date of this ordinance is hereby ratified
and confirmed.
Section 4. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
