AN ORDINANCE of the City of Kent,
Washington relating to City property; adding a
new Chapter 2.31 Kent City Code establishing a
process and procedure for rewards for
information leading to the arrest and
prosecution of persons responsible for
destruction of City property.
THE CITY COUNCIL OF THE CITY OF KENT, WASHING'T'ON DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. A new Chapter 2.31 Kent City Code is added as
follows:
2.31.010. REWARD ESTABLISHED. In the public interest a
standing reward in the sum up to five hundred ($500) dollars is
hereby established for information leading to the arrest and
prosecution of the person or persons responsible for each act of
damage to, and/or destruction of, any City property.
2.31.020. REWARD ELIGIBILITY. In order to be eligible
for a reward pursuant to 2.31.010, the individual furnishing said
information must testify or be willing to testify at any hearing
or trial held to determine the guilt or liability of the person or
persons alleged to be responsible for each act of damage to,
or/and destruction of, City property. Said testimony shall be as
to facts and circumstances known to the individual and furnished
to the City of Kent.
2.31.030. PAYMENT FROM GENERAL FUND. Reward payment
shall be charged against the General Fund, upon certification from
the City Administrator, upon consultation with the City Attorney
and affected Department.
2.31.040. The offer of reward, established by this
Chapter 2.31, shall be posted in conspicuous public places
throughout the City of Kent, as the City Administrator shall
direct, and shall be widely distributed to the news media within
this area.
2.31.050. CERTAIN PERSONS INELIGIBLE. The officers and
employees of the City of Kent, members of their immediate family,
and their kindred to the fourth (4th) degree are excluded from
application of the provisions of this section.
Section 2. Any act consistent with the authority and
prior to the effective date of this ordinance is hereby ratified
and confirmed.
Section 3. The provisions of this ordinance are declared
to be separate and severable. The invalidity of any clause,
sentence, paragraph, subdivisions, section or portion of this
ordinance, or the invalidity of the application thereof to any
person or circumstance shall not affect the validity of the
remainder of the ordinance, or the validity or its application to
other persons or circumstances.
Section 4. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
