AN ORDINANCE of the City of Kent,
Washington, vacating a portion of an alley
between S. Bridges Street and S. Central
Avenue, located south of Willis Street.
[Application of Southland Corporation].
WHEREAS, a proper application was filed with the City of
Kent for the vacation of a dedicated public alley of the City; and,
WHEREAS, the Kent City Council did, by Resolution 1039,
adopted on December 3, 1984, fix a time when said petition would
be heard, and said hearing was held, on proper notice, on
January 7, 1985 at the hour of 7 o'clock p.m. in the Council
Chambers of the City Hall of the City of Kent, Washington; and
WHEREAS, the Kent Planning Director and the Director of
the Department of Public Works processed said petition and secured
the technical facts pertinent to the question of said vacation
which includes a sketch of the proposed vacation and the written
reports with respect to water, sewer, and streets of the City; and
WHEREAS, it appearing that the granting of said petition
would not be a menace or inconvenience to the traveling public or
to any other person using the streets or alleys of the City of
Kent, Washington; and
WHEREAS, the Council approved the grant of the alley
vacation on certain conditions, as specified herein; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. That portion of an alley between S. Bridges
and S. Central Avenue, located south of Willis Street, more
particularly described as follows:
That portion of the north and south alley
in Block 4, of the Original Plat of the
Town of Kent, described as follows:
Beginning at the northeast corner of Lot 1
of said Block 4, then south along the east
line of Lots 1 and 4 of said Block 4, a
distance of 120 feet; thence east 20 feet,

thence north 16 feet, thence west 15 feet,
thence north parallel to the east lines of
said Lots 1 and 4, 104 feet to the south
line of Willis Street, thence west 5 feet
to the Point Of Beginning.
is hereby vacated; RESERVING, however, an easement for drainage,
and overhead and underground utilities in said portion of the
alley vacated; and, PROVIDED FURTHER, that the following condi-
tions be met:
A. The City expressly reserves for itself an ease-
ment for ingress and egress across the southerly sixteen feet of
the above-described property.
B. Amount of compensation to the City shall be
one-half of the appraised value of the vacated alley; provided,
however, that amount shall be set off against the credit to the
applicant for property previously deeded to the City pursuant to
Ordinance 2505.
Section 2. No vested right shall be affected by the
provisions of this ordinance.
Section 3. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
