ORDINANCE NO. S
AN ORDINANCE of the City of Kent,
Washington relating to building codes; amending
Chapter 14.08, Kent City Code, to delete the
requirement for a performance bond, and
amending the provisions relating to house
moving permits.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Section 14.08.04 Kent City Code, (Ordinance
1140, Section 1) is hereby repealed.
Section 2. Section 14.08.08, Kent City Code, (Ordinance
1140, Section 2 ) is hereby amended to read as follows:
14.08.(J48 -H010. Requirements in Addition to Building
Code
The requirements of this chapter shall be in addition to
all existing requirements of the Building Code and ordinances of
the City of Kent.
Section 3. Section 14.08.12, Kent City Code, (Ordinance
1791, Section 1), Section 14.08.16, Kent City Code, (Ordinance
1791, Section 2), Section 14.08.20, Kent City Code, (Ordinance
1140, Section 5), and Section 14.08.24, Kent City Code, (Ordinance
1791, Section 3) are hereby repealed.
Section 4. A new section, Section 14.08.020 Kent City
Code, is added as follows:
14.08.020. Permit - Inspection
A. Permit Required. No person, firm, or corporation
shall move or remove any building or structure
within the City of Kent, without first obtaining a
building moving permit.
B. Application for Permit - Preliminary Inspection.
1. To obtain a permit, the applicant shall file an
application in writing on a form furnished by the
Building Department. The application shall
include payment of the inspection fee, as set
forth in this ordinance.
2. Upon receiving the application and inspection
fee, the Building official, or his or her
designee, shall schedule an inspection of the
building or structure to be moved. The
inspection shall occur not later than fourteen
(14) days after the application and fee are
submitted.
3. The Buildinq official, or his or her designee,
shall inspect the building or structure to
determine compliance with the building code and
other appropriate City codes and ordinances. The
findings of the Building official, or his or her
designee, shall be in writing and shall be
transmitted to the applicant.
4. If the buildinq or structure is being moved from
the City, the applicant shall verify that the
sewer is capped, the septic tank is removed, or
that the septic tank has been filled with inert
material. The applicant shall also verify that
all utility charges have been paid.
C. Plans and Specifications Required
The applicant shall file with the City Buildin
Department complete plans and specifications for the
building or structure as it is proposed to be when
completed and in place upon its site in the City of
Kent.
Section 5. A new section, Section 14.08.030 Kent City
Code is added as follows:
14.08.030. Permit -Issuance
A. If the Building Official finds that the work
described in an application for a permit and the
plans, specifications, and other data filed
therewith conform to the requirements of this
chapter and other pertinent laws and ordinances, and
that the fees specified in this chapter have been
paid, he shall issue a building moving permit to the
applicant.
1. No building moving permit shall be issued until
the applicant provides a Certificate of Insurance
identifying the City of Kent, its officers and
employees as are named insured, covering damage
to person or property, arising out of or in
consequence of the acts authorized by this
permit, in an amount not less than $100,000.00,
per occurrence.
2. The applicant must acquire all other permits and
licenses, including foundation, zoning, and
public works permits, as necessary.
B. Every permit issued by the Building Official under
the provisions of this chapter shall expire by
limitation if the building or work authorized by
such permit is not commenced within 180 days from
the date of such permit.
Section 5. A new section, Section 14.08.040, Kent City
Code, is added as follows:

14.08.040. Fees
A. Inspection Fee - An inspection fee of $35.00 shall
be collected by the Building Official before a
preliminary inspection is conducted.
B. Permit Fee - A permit fee of 135.00 shall be
collected by the Building Official before a permit
is issued.
C. Other Permit Fees - Permit fees required for other
necessary permits shall be as set forth in the Kent
City Code.
Section 6. Appeals of this Chapter are authorized in
accordance with Chapter 14.01, Kent City Code.
Section 7. Any ordinance in conflict herewith is
superseded by the provisions of this ordinance.
Section 8. Any act consistent with the authority and
prior to the effective date of this ordinance is hereby ratified
and confirmed.
Section 9. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
