SUBJECT: VETOED ORDINANCES 2513 and 2514
Both of these vetoes were "philosophical", knowing they had passed 7 to 0.
The East Hill Rezone (Ordinance 2513) represents the same kind of mentality
that prevailed with the industrial over -zoning that occurred in the valley a
few years ago. Real estate salesmen and developers convinced the council of
the tremendous "need" for warehousing zoning which resulted in some ware-
houses being built with a programmed vacancy for two or three years; clearly
a tax benefit for the developer not for the City's best interest. Ironically,
the council, having used the 75 percent developed -loophole to accommodate the
zone changes on East Hill now has Fred Meyer stating Kent can wait two years
for their products. If you had looked all over Kent for the worst place to
impact a neighborhood, a school or an already congested traffic situation,
you couldn't have found a better place to accomplish it.
Regarding the Budget, Ordinance 2514, my philosophy is to find a way to do
the things which need to be done to improve the community. There are many
worthwhile issues among the $5 million capital improvement projects which
could be done by utilizing the revenue sources available to the City. When
we had to discontinue the environmental tax, the real estate excise tax was
available to us as an alternative. As an example, had we utilized the real
estate excise tax in 1984, the $275,000 revenue we would have received could
have built the pedestrian overpass at Sequoia or at Kent Commons, or at the
most recently requested one on Kent-Kangley in the vicinity of the Earthworks.
I deplore the fact that we haven't moved ahead with more parking for Kent
Commons, enabling it to accommodate the larger, revenue-producing events.
We can't move ahead with logical expansion of the golf course without the
Lopez and Dugan properties. The yearly $300,000 allocation over a four -
five year period for a new library is essential if we are to keep pace with
all the growth that is projected.

AN ORDINANCE of the City of Kent,
Washington, relating to planning and property,
rezoning with conditions, various parcels of
property on Kent's East Hill, located generally
in the area bounded by S.E. 232nd Street on the
north, S.E. 248th Street on the south, 98th
Avenue S.E. on the west, and 112th Avenue S.E.
on the east (East Hill Zoning).
WHEREAS, by Resolution 1027, the City Council of the City
of Kent directed the Kent Planning Commission to review property
on the East Hill and recommend, if appropriate, amendments to the
Zoning Code to rezone property consistent with amendments to the
Comprehensive Plan, East Hill component (Resolution 972 as
amended); and
WHEREAS, the Planning Commission undertook such a study
of the property bounded by S.E. 232nd Street on the north, S.E.
248th Street on the south, 98th Avenue S.E. on the west, and 112th
Avenue S.E. on the east; and
WHEREAS, a Declaration of Nonsignificance was filed by
the Planning Department on September 27, 1984; and
WHEREAS, the Planning Department issued its staff report
on September 21, 1984; and
WHEREAS, public hearings were held on October 9,
October 16 and October 30, 1984, and testimony relating to the
zoning of various parcels within the study area was heard and
considered; and
WHEREAS, the Planning Commission recommended that various
parcels be rezoned as follows:

WHEREAS, the City Council on November 19 adopted the
Findings of Fact contained in the Planning Department's staff
report and the recommendation of the Planning Commission and
approved by motion a rezone to conform with the Planning
Commission recommendation, with the following conditions imposed
as to Parcel 5: That prior to the issuance of any development
permit (building, zoning, etc.) for a permitted use of the
property herein zoned which abuts S.E. 240th Street and/or 108th
Avenue S.E. (or the southerly extension thereof), property shall
be deeded there from for street purposes in accordance with the
following right-of-way criteria:
STREET RIGHT OF WAY WIDTH
S.E. 240th St. The south half of the street
right-of-way as measured from and
perpendicular to the north section
line of Section 20, Township 22N,
Range 5E, W.M., shall be 38 feet.
108th Ave. S.E. 60 feet in width as measured from
and perpendicular to the southerly
projection of the existing
northerly centerline of 108th Ave.
S.E. plus 25 -foot radii at the
intersection points of the
right-of-way with the S.E. 240th
Street right-of-way.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. The findings contained in the staff report of
the Planning Department, dated September 21, 1984, are hereby
adopted.
Section 2. The following described land situated in the
City of Kent, County of King, State of Washington, and more
particularly described as: Lot 1 and the east one-half of Lot 3
of Hurlow's Short Plat (SP 78-38) as recorded under King County
Auditor's No. 7812200838,
is hereby rezoned as follows: From 0, Office to CC, Community
Commercial.
Section 3. The following described land situated in the
City of Kent, County of King, State of Washington, and more
particularly described as: Lot 1 of R.O. Smith's Orchard Tracts
Addition to Kent, less the easterly 75 feet thereof,
is hereby rezoned as follows: From R1-7.2, Single Family
Residential to O, Office.
Section 4. The following described land situated in the
City of Kent, County of King, State of Washington, and more
particularly described as: Lot 2 and the easterly 75 feet of
Lot 1 of R.O. Smith's Orchard Tracts Addition to Kent,
is hereby rezoned as follows: From R1-7.2, Single Family
Residential to CC, Community Commercial.
Section 5. The following described land situated in the
City of Kent, County of King, State of Washington, and more
particularly described as: South 1/2 of Lot 3 of the R.O. Smith's
Orchard Tracts Addition to Kent,
is hereby rezoned as follows: From R1-7.2, Single Family
Residential to CC, Community Commercial.

Section 6. The following described land situated in the
City of Kent, County of King, State of Washington, and more
particularly described as: Lots 7 and 8 of R.O. Smith's Orchard
Tracts Addition to Kent,
is hereby rezoned as follows: From MR -M, Medium Density
Multifamily Residential to CC, Community Commercial.
Section 7. The rezone of Lots 7 and 8 of R.O. Smith's
Orchard Tracts Addition to Kent is subject to and expressly
conditioned upon the following: Prior to the issuance of any
development permit (building, zoning, etc.) for a permitted use of
the property herein zoned which abuts S.E. 240th Street and/or
108th Avenue S.E. (or the southerly extension thereof), property
shall be deeded therefrom for street purposes in accordance with
the following right-of-way criteria:

thereto, the zoning of said property as provided for in Sections 2
through 6 of this ordinance.
Section 9. That upon said amendment being shown upon the
Comprehensive Zoning Map of the City of Kent or upon an addendum
thereto, a copy of said map or addendum shall be filed with the
Director of Records and Elections of King County, Washington, and
the City Clerk of the City of Kent is hereby authorized and

directed to record this ordinance with the County Auditor of King
County and pay the filing fee therefor.
Section 10. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
