AN ORDINANCE of the City of Kent, Washington, amending the Kent Subdivision Code (Ordinance No. 1840) to authorize additional one-year extensions for the filing of a final plat, as authorized by RCW 58.17.140. WHEREAS, RCW 58.17.140 provides that a final plat shall be submitted for approval within three years of the date of preliminary plat approval; and WHEREAS, an applicant who files a written request with the City of Kent legislative body at least thirty days before the expiration of the three-year period shall be granted one one-year extension upon a showing that the applicant has attempted in good faith to submit the final plat within the three-year period; and WHEREAS, RCW 58.17.140 further provides that the City may by ordinance allow other extensions of time that may or may riot contain additional or altered conditions and requirements; and WHEREAS, the City of Kent has determined that it is in the best interest of the City to allow additional time extensions beyond the additional one-year extension when an applicant can show unusual circumstances or situations which make it impossible to file the final plat within the periods provided; and WHEREAS, said extensions of time may or may not contain additional or altered conditions and requirements as determined by the City Council; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES ORDAIN AS FOLLOWS: Section 1. Section 2.3.2, paragraph 8 of the Kent Subdivision Code (Ordinance 1840) is amended to read as follows: "8) Expiration Date. Preliminary plat approval shall lapse three (3) years from the date Of approval unless a final plat based on the preliminary plat, or any phase thereof, is submitted within three (3) years from the date of preliminary plat approval. One one-year extension shall be granted to an applicant who files a written request with the City Council and Planning Department at least thirty (30) days before the expiration of this three-year period, if the applicant can show that he has attempted in good faith to submit the final plat within the three-year period. Additional time extensions beyond this one-year time period may be granted by the City Council if the applicant can show unusual circumstances or situations which make it im ossible to file the final plat within the four-year time period. The applicant must file a written request with the City Council and Planning De artment for this additional time extension; this request must be filed at least thirty 30) days prior to the plat expiration date The request must include documentation as to the need for the additional time period. Addi- tional time extensions shall be granted in not greater than one 1 year increments In the case of a phased subdivision, final plat approval by the City Council of any phase of the preliminary plat will constitute an auto- matic one (1) year extension for the filing of the next phase of the subdivision. Section 2. Effective Date. This ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as provided by law.
