ORDINANCE NO. '�'�
AN ORDINANCE of the City of Kent,
Washington vacating a portion of Cedar Street,
a certain street within the City Limits of the
City of Kent, and more particularly described
as follows: That portion of Cedar Street in the
northwest quarter of Section 19, Township 22
North, Range 5 East, W.M., in King County,
Washington, lying south of S.G. Mickelson's
Sunnyside Addition as recorded in Volume 45 of
Plats, Page 23, Records of King County,
Washington, and lying north of Block 3 of
Sunnyside Addition to Kent as recorded in
Volume 18 of Plats, Page 66, Records of King
County, Washington, and lying east of the
northerly extension of the west line of Lot 6
of said Block 3 and lying west of that portion
of said Cedar Street which was vacated by Kent
City Ordinance 1364. [APPLICATION OF FIRST
CHURCH OF THE NAZARENE]
WHEREAS, a proper application was filed with the City of
Kent for the vacation of a dedicated public street of the City; a
WHEREAS, the Kent City Council did by Resolution 983
adopted on December 21, 1982, fix a time when said petition would
be heard, and said hearing was held, on proper notice, on
January 17, 1983 at the hour of 7:00 p.m. in the Council Chambers
of the City Hall of the City of Kent, Washington; and
WHEREAS, the hearing was continued to February 22, 1983,
at the hour of 7:00 p.m. in the Council Chambers of the City Hall
of the City of Kent, Washington; and
WHEREAS, the Kent Planning Director and Director of the
Department of Public Works processed said petition and secured
technical facts pertinent to the question of said vacation which
includes a sketch of the proposed vacation and the written reports
with respect to water, sewer and streets of the City; and
WHEREAS,it appeared that the granting of said petition
would not be a menace or inconvenience to the traveling public or

to any other person using the streets or alleys of the City of
Kent, Washington; and
WHEREAS, the Council approved the grant of the street
vacation on certain conditions, as specified herein; NOW, THEE
THE CITY OF KENT WASHINGTON DOES ORDAIN AS FOLLOWS:
Section 1. That portion of Cedar Street within the City
Limits of Kent, Washington and more fully described as follows:
That portion of Cedar Street in the northwest
quarter of Section 19, Township 22 North, Range 5
East, W.M., in King County, Washington, lying
south of S.G. Mickelson's Sunnyside Addition as
recorded in Volume 45 of Plats, Page 23, Records
of King County, Washington, and lying north of
Block 3 of Sunnyside Addition to Kent as recorded
in Volume 18 of Plats, Page 66, Records of King
County, Washington, and lying east of the
northerly extension of the west line of Lot 6 of
said Block 3 and lying west of that portion of
said Cedar Street which was vacated by Kent City
Ordinance 1364.
is hereby vacated; RESERVING, however, an easement for drainage,
and overhead or underground utilities in said portion of Cedar
Street; and, PROVIDED FURTHER, that the following conditions be
met.
A. The vacation excludes the westerly 105 feet of Cedai
Street and requires the deeding, to the City, of sufficient
additional property from the adjacent property owners in the
vicinity of the westerly 105 feet, for cul de sac turnaround.
Said cul de sac turnaround shall have a radius of 55 feet with the
center point located at the intersection of the right-of-way
center line of Cedar Street and the northerly projection of the
easterly lot line of Lot 6, Block 3 of Sunnyside addition to Kent,
as recorded in Volume 18 of Plats, Page 66, Records of King
County, Washington.
B. The City retain an easement for pedestrian
right-of-way over that portion of Cedar Street approved for
vacation, and prohibit any fencing which would interfere with CitJ
maintenance practices or operations.
C. Prohibit vehicular access to Cedar Street from the
church owned, leased or operated properties.
D. Compensation to the City for one half of the
appraised value of the vacated street.

Section 2. No vested rights shall be affected by the
provisions of this ordinance.
Section 3. Effective Date. This ordinance shall take
effect and be in force five (5) days from and after its passage,
approval and publication as provided by law.
