ORDINANCE NO.::;� 1-/ "ILI 22 AN ORDINANCE of the City of Kent, Washington vacating a portion of an alley connecting State and Kennebeck Streets between Smith and Ward Streets, and more particularly described as the east 96.00 feet of the west 171.00 feet of alley in Block 14 Washington Central Improvement Company's First Addition to the Town of Kent, as recorded in Volume 3 of plats, Page 97, Records of King County, all within the City of Kent. [APPLICATION OF VALLEY MEDICAL CENTER] WHEREAS, a proper application was filed with the City of Kent for the vacation of a dedicated public alley of the City; and WHEREAS, the Kent City Council did by Resolution 1011, adopted on April 16, 1984, fix a time when said petition would be heard, and said hearing was held, on proper notice, on May 21, 1984 at the hour of 7:00 p.m. in the Council Chambers of the City Hall of the City of Kent, Washington; and WHEREAS, the petition was processed by the Kent Planning Director and the Department of Public Works and necessary technical facts pertinent to the question of said vacation was provided by affected departments; and WHEREAS, it appears that the granting of said petition would not be a menace or inconvenience to the traveling public or to any other person using the streets or alleys of the City of Kent, Washington; and WHEREAS, the City Council directed the preparation of an ordinance vacating said street on certain conditions as set forth herein; NOW, THEREFORE THE CITY OF KENT WASHINGTON DOES ORDAIN AS FOLLOWS: Section 1. That portion of an alley connecting State and Kennebeck Streets, between Smith and Ward Streets, more particu- larly described as follows: 0 The east 96.00 feet of the west 171.00 feet of alley in Block 14 Washington Central Improvement Company's First Addition to the Town of Kent, as recorded in Volume 3 of plats, Page 97, Records of King County. is hereby vacated; RESERVING, however, an easement for utility purposes in said portion of vacated alley; and, PROVIDING FURTHER, that A. Ingress and egress to and from the Kent Drugs parking lot through the alley to Kennebeck Avenue be continued to assure vehicle circulation and mitigate traffic impacts. B. Compensate the City for one half the appraised value of that portion of the alley to be vacated. Section 2. No vested rights shall be affected by the provisions of this ordinance. Section 3. Effective Date. This ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as provided by law.
