Box 31 220 S. 4th A Attn: Carol 01% 01% CD J Ln O O ,r. co '7 k,+y, __ 94la nent Dept. -7 S lg84 Kent, WA 98031 It f.n, OF L, ORDINANCE NO. iJ ii' ` `1 <12 FOLLOWS: AN ORDINANCE of the City of Kent, Washington, providing for the acquisition of certain properties for the improvement of the Municipal Water System, a system of aqueducts, reservoirs, pumping stations and other struc- tures for conveying into and through the City of Kent a supply of fresh water, and for the purpose of protecting such supply of fresh water from pollution; providing for the condem- nation, appropriation, taking and damaging of land and other property rights necessary there- fore; all located within the Northwest and Southwest quarters of Section 4, Township 21 North, Range 5 East, W.M., in King County, Washington. [In re Kent Water Impoundment Facility.] THE CITY OF KENT, WASHINGTON, DOES HEREBY ORDAIN AS Section 1. That public convenience, use and necessity demand that the following described real property in King County, Washington be and the same is hereby condemned for the improvement of the Municipal Water System, a system of aqueducts, reservoirs, pumping stations and other structures and appurtenances for conveying into and through the City of Kent a supply of fresh water, and for the purpose of protecting such supply of fresh water from pollution, to -wit: A9 The East 194 feet of the North half of the 3�0 South half of the Southeast quarter of the (� Northwest quarter of Section 4, Township 21 North, Range 5 East, W.M., in King County, Washington; EXCEPT County road. AND ALSO; 0 The North half of Lot 11 of the Sound Trustee Company's Third Addition, according to the plat thereof recorded in Volume 13 of Plats on page 100, records of King County, Washington; EXCEPT the West half of the North half of the North half of said Lot 11. AND ALSO; ,j The South 120.00 feet of Tract 10, of the Sound Trustee Company's Third Addition, according to �t� the plat thereof recorded in Volume 13 of 0I% O^ 0 J LnCDO d co Plats, page 100, records of King County, Washington. Section 2. That in the condemnation of the property described in Section 1 for the improvement of the Municipal Water System, and for general municipal purposes, the City shall acquire the fee interest in the following described property in King County, Washington, to -wit: The East 194 feet of the North half of the o3�D South half of the Southeast quarter of the Northwest quarter of Section 4, Township 21 North, Range 5 East, W.M. in King County, Washington; EXCEPT for County road. AND ALSO: That portion of the North one half of Tract 11, Sound Trustee Company's Third Addition, as recorded in Volume 13 of Plats, page 100, records of King County, Washington; lying Easterly of the following described line: beginning at the Southeast corner of said North k��� one half; thence West along the South line of � said North one half, a distance of 135.00 feet to the True Point Of Beginning of line herein described; thence in a Northwesterly direction in a straight line to a point on the North line of said tract which point lies 313.36 feet West of the Northeast corner of said tract and is the terminus of the line herein described. AND ALSO; The East one half of the South 120 feet of Tract 10, of the Sound Trustee Company's Third Addition, according to the plat thereof (01ka recorded in Volume 13 of Plats, page 100, records of King County, Washington. Section 3. All lands, rights, privileges and other property lying within the limits of the lots, blocks and tracts of land described in Sections 1 and 2 hereof are hereby condemned, appropriated, taken and damaged for the purpose of improving the Municipal Water System and other public use and all lands, rights, privileges and other properties are to be taken, damaged and appropriated only after just compensation has been made, or paid into court for the owners thereof in a manner provided by law. - 2 - O` LT` C) O U-) O C'r7 O "Zr o Section 4. That the entire cost of the improvement and acquisition provided for by this ordinance shall be paid from the Utility Fund, or from such general funds of the City of Kent as may be provided by law. Section 5. That the City Attorney be and he is hereby authorized and directed to begin and prosecute the actions and proceedings in the manner provided by law to condemn, take, damage and appropriate the lands and other property necessary to carry out the provisions of this ordinance. That in conducting said condemnation proceedings, the City Attorney is hereby authorized to enter into stipulations for the purpose of minimizing damages. Section 6. Effective Date.
