HomeMy WebLinkAbout2939ORDINANCE NO. AN ORDINANCE of the City of Kent, Washington, relating to closure of the outlet on First Avenue North to Smith Street in the City of Kent. WHEREAS, it is necessary for construction and operation of the Kent Library to close the outlet of First Avenue to Smith Street; and WHEREAS, the Council duly conducted a public hearing on September 4, 1990 to determine whether such closure would create an undue burden upon traffic and adverse impact upon access to businesses in the central business district of the City; and WHEREAS, the Council has determined that such closure and traffic revision is declared to be an emergency and is beneficial for the public's health, safety and welfare to close such outlet; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Findings. The Council finds that the permanent closure of the outlet of First Avenue at the intersection of Smith Street is necessary for the construction and operation of the Kent Library site which is generally located between First and Second Avenues on Smith Street. The Council further finds that such closing will not create an undue burden on traffic nor adversely affect businesses and properties and that such closure is in the best interest of the City to close such street outlet and that such action is an emergency. Section 2. Street Closure. The Public Works Department is directed to place gates or other barriers and signs to traffic at each end of the First Avenue street section to be closed signifying traffic revision and street closure for purposes of entry or exit from First Avenue onto Smith Street and Smith Street onto First Avenue and permitting use of the southerly entrance of that remaining portion of First Avenue lying between Meeker and Smith Streets as a public street open to the public to traffic following completion of project construction. Section 3. The provisions of this ordinance are declared to be separate and severable. The invalidity of any portion of this ordinance shall not affect the remainder, or the validity of its application to other persons and circumstances. Section 4. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and confirmed. Section 5 Effective Date. This ordinance shall take effect and be in force thirty (30) days from the time of its final passage as provided by law Council, in which case it ess passed by unanimous vote of the be effective immediately.
