HomeMy WebLinkAbout2916Ordinance No. 2916 (Amending or Repealing Ordinances) CFN=171 -Traffic Control Passed 4/17/1990 Relating to Parking, Prohibiting the Storage and Parking of Certain Commercial Vehicles on City Streets Amended by Ord. 3850 (Secs. 9.38.130; 9.38.140) Amended by Ord. 3974 (Secs. 9.38.120;9.38.130;9.38.140) I ORDINANCE NO. , AN ORDINANCE of the City of Kent, Washington, relating to parking, prohibiting the storage and parking of certain commercial vehicles on the city streets, adding Kent City Code 10.06.090 and amending Kent City Code 10.06.100. WHEREAS, the parking of commercial trucks, vans, trailers; and semi -trailers upon city streets poses a risk and hazard to the 'public's health, safety and welfare, including, but not limited 11 Ito, view obstruction, the decorum of certain neighborhoods, noise (disturbance and obstruction of vehicular traffic; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES `,HEREBY ORDAIN AS FOLLOWS: Section 1. The City Council finds that the parking and ''jstorage of commercial trucks, vans, tractor trailers, and semi -trailers with a maximum gross vehicle weight exceeding 8,000 ';'pounds presents unacceptable risks and hazards to public health, safety and welfare for such vehicles parked or stored on city '!streets at times when such vehicles are not engaged in business or: commercial activity. Section 2. A new section is added to Kent City Code 10.06.090 as follows: A. Parking and Storage of Vehicles. No commercial ;;truck vehicle van trailer, or semi -trailer whether licensed or' lunlicensed exce ding 8..000 pounds as defined in R 46.44.036 ,46 44 037, or 46 44 041 may be stored or parked upon_any city ;street for longer than two hours, except for those periods of time ;when such vehicle is being loaded or unloaded or where parking or :storage is otherwise proh_ibited. B. Penalty. Any violation of Kent City Code 110 06 090(A) shall be an infraction and punishable by a monetary ;penalty not more than $100; provided, however, that for any person Section j. -- follows: 10.06.100. ((N)) no Trailer or semi -trailer shall :C The parked upon any City street unless the trailer or semi -trailer is attached to a vehicle by which it may be propelled or drawn; ,provided, that in case of accident such trailer or semi -trailer ;may be moved to the side of the street; and, if a good and sufficient red signal be displayed at both ends thereof during the jhours of darkness, such trailer or semi -trailer may be permitted for allowed to remain for a period not exceeding twenty-four hours jof pending removal except that such trailer or semi -trailer shall ';not remain upon any portion of a City street where standing or Jparking is limited or prohibited for a period longer than is ,necessary to effect its removal. (0.2508, §2) B. Penalty. Any violation of KCC 10.06.100(A) shall be an infraction and punishable by a monetary penalty of not more than one -hundred dollars; provided, however, that for any person ,not requesting a mitigation hearing or contested hearing, the penalty shall be twenty-five dollars. Vehicles in violation are :also subject to impoundment as provided by law. (0.2582, §1) Section 4. Effective Date. This ordinance shall take ,'.effect and be in force thirty (30) days from the time of its final', passage as provided by law.
