HomeMy WebLinkAbout2972ORDINANCE NO. GI AN ORDINANCE of the City of Kent, Washington, adding new sections 9.02.17 and 9.02.18 to the Kent Municipal Code relating to the hindering of law enforcement. THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Kent Penal Code Chapter 9.02 is amended by adding thereto a new section 9.02.17 to read as follows: 9.02.17. HINDERING LAW ENFORCEMENT. A. As used in this section hindering law enforcement means to intentionally prevent, hinder or delay the apprehension or prosecution of another person whom the actor knows: 1�1 has committed a crime; or LL is being sought by law enforcement officials for the commission of such offense; or _Q1 has escaped from Jail or prison. B. A person is guilty of hindering law enforcement if -respect to a person described in Subsections (A)(1) (2) or (3) he knowingly: 111 harbors or conceals such person; or _= warns such person of impending discovery or of apprehension; or (3-1 Rrovides such ith-money, transportation, dis uise or other me ns of avoiding discovery or • • - • or prevents or obstructs by use of force or - •- •- S • •� •n •- • �n �• �. • in the discovery or • • - - _ • of such • - - • or J_U conceals� alters or destroys any Rhysical evidence that -might aid in the discovery • • • - - • of person. Section 2. Kent City Penal Code Chapter 9.02 is amended by adding thereto a new section 9.02.18 to read as follows: 9.02.18. ESCAPE. A. "Official Detention" means: LU restraint pursuant to a lawful arrest for an offense; or .U1 lawful confinement in the Kent Corrections Facility; or LU custody for gur2oses incident to the foregoing jincluding but not necessarily limited to: LaI transportation; or (b) medical diagnosis or treatment; or Lcl court appearances; or Ldj_ work and recreation. B A person is guilty of escape if, without lawful (authority he intentionally removes himself from official detentioor n fails to return to official detention following temporary leave Igranted for a specified purpose or limit. - 2 - Section 3.
