HomeMy WebLinkAbout3213ORDINANCE NO. ;2 3 AN ORDINANCE of the City Council of the City of Kent, Washington, authorizing the publication and distribution of a local voter's pamphlet for the special election of April 25, 1995 relating to Initiative Petition 101 establishing a curfew for juveniles within the City of Kent. WHEREAS, a Citizens' Initiative Petition No. 101 was filed with the City Clerk on January 23, 1995, and has been certified as sufficient pursuant to RCW 35A.11.100; and f WHEREAS, pursuant to RCW 35.17.260 and KCC 1.30.170, ';the City Council, at its regularly scheduled meeting of jFebruary 7, 1995, considered the issue of the Initiative Petition j and moved to call for a special election on the proposed 4 ordinance to be held April 25, 1995 by mail ballot; and • i WHEREAS, the City Council, in conjunction with the mail j !I ballot election, desires to publish and distribute a local. voter's pamphlet on the matter of Initiative Petition 101; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: i; SECTION 1. That pursuant to RCW 29.81A.010, there is ii �fhereby authorized the publication and distribution of a local ,'voter's pamphlet on the matter of Initiative Petition 101, which 'f ;,would add a new chapter to Title 9 of the Kent City Code entitled �I! a �!"Juvenile Safety and Family Reconciliation", establishing a curfew for juveniles within the City of Kent. SECTION 2. That pursuant to RCW 29.81A.080, a ,;committee be appointed to prepare arguments advocating voters' ;',approval of the measure, and that another committee be appointed !!to prepare arguments advocating voters' rejection of the measure. I SECTION 3. That the City Clerk is directed to file ",this ordinance and other related material required with King !,County for the purpose of publication and distribution of the voter's pamphlet on the matter of Initiative Petition 101. i SECTION 4. That City Administration is authorized to :expend funds necessary to carry out the special election and the publication and distribution of the voter's pamphlet, as set "!forth in this ordinance. SECTION 5. Severability. If any section, sentence, 1i clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such 2 invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. SECTION 6. Effective Date. This ordinance shall take effect and be in force five (5) days from and after its i,publication as provided by law.
