A RESOLUTION of the Council of the City of Kent,
Washington, retaining counsel for certain services
in connection with the issuance and sale of $100,000
in general oblig~tion bonds of the city.
WHEREAS, the City of Kent, Washington, is contemplating
the construction and equipping of a public library, and the acqui-
sition of a site therefor or the construction thereof on property
now owned by the city; and
WHEREAS, in order to provide funds to pay the cost thereof
the City is contemplating the issuance and sale of its general
obligation bonds in the principal sum of not to exceed $100,000,
said bonds to be paid by annual tax levies in excess of the 15-mill
limitation of taxes now permitted to cities without a vote of the
people; and
WHEREAS, the Constitution and Laws of the State of Washing-
ton require that the questions of whether or not said bonds may be
issued for such purposes must be submitted to the qualified electors
of the city for their ratification or rejection; and
WHEREAS, it is deemed necessary and advisable that muni-
cipal bond counsel skilled in such matters be retained to draw the
ordinances, resolutions, notices and other documents necessary for
said election and the issuance and sale of said bonds, and to give
their OP.inion as to the validity of said bonds at the time of their
delivery;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Kent, Washington, as follows:
That Preston, Thorgrimson & Horowitz, attorneys at law
of Seattle, Washington, be and they hereby are retained to perform
the services above set forth, and as compensation therefor the City
agrees to pay them the sum of Four Hundred Fifty Dollars ($450),
and further agrees to reimburse said counsel for all out-of-pocket
expenses, such as long distance telephone calls, which they may
incur in the performance of said services. In the event said
election fails to carry, the city agrees to pay said counsel the
sum of One Hundred Twenty-five Dollars ($125).
In addition to the above, the city agrees to furnish said
counsel at their office in Seattle, Washington, with a complete
certified transcript of all proceedings taken in the matter of the
issuance of said bonds.
PASSED by the Council of the City of Kent, Washington,
and approved by its Mayor at a regular meeting of said Council held
this 6th day of January, 1958.
